Proscia® Issued U.S. Patent Covering System and Method of Processing Medical Images for Inspection or Analysis


Proscia, a leading provider of digital pathology software, has been granted U.S. Patent No. 10,346,980 by the United States Patent and Trademark Office (USPTO). The patent applies to techniques for processing and analyzing medical images.

For more than 150 years, the standard of care for diagnosing tissue biopsies has been based on a pathologist’s interpretation of patterns using a microscope. This interpretation determines the presence of cancer as well as the aggressiveness of malignancies. Unfortunately, because this human assessment is inherently subjective, it can compromise the accuracy of diagnosis and ultimately, the success of patient outcomes.

Today, specialized scanners capture images of tissue samples prepared on glass slides, giving rise to digital pathology. These whole slide images offer resolution and clarity equivalent to that provided by a microscope and can be viewed on a computer workstation. Significantly, computational models leveraging artificial intelligence can also analyze this image data, generating new insights into how we understand cancer; however, technical limitations pose a barrier to performing this analysis in practice. Specifically, the sizes of whole slide image files, ranging from hundreds of megabytes to dozens of gigabytes, present difficulties for computer systems attempting to manipulate, read, and analyze them.

The computer processing of whole slide images, as well as the retrieval and visualization of image analysis results, in acceptable time frames remains a long-standing problem. U.S. Patent No. 10,346,980 covers broad techniques for delivering much-needed efficiencies for overcoming these challenges and making whole slide imaging a viable component of the traditional pathology workflow.

These techniques allow for the efficient parallelized analysis of whole slide images, as well as the rapid delivery of rich quantitative and spatial information, in a digital pathology viewing environment. Integrating image viewing and analysis visualization supports high-throughput tissue research, helping to drive breakthrough advancements in the fight against cancer. It also enables computational pathology workflows for diagnosis, allowing pathologists to read and analyze cases more rapidly and with higher levels of accuracy.

New Technologies Could Enhance Air Force Cancer Screenings

Questions around the rise in cancers in former Air Force pilots are causing concerns about the role of cockpit radar and current cancer screening technologies used by the military. Those questions are also elevating the need for new cancer detection processes to catch possible tumors sooner and less invasively. Paul Crowe, CEO of NuView Life Sciences, highlights the important of non-invasive confirmatory cancer screenings in light of this recent study.

“These fighter pilots fought for our lives -we need to fight for theirs with confirmatory cancer tests,” said Crowe. “Testing for all is extremely important, but this event especially draws attention to the overwhelming need to relook at cancer screening within the healthcare industry today.”

According to a recent Veterans Affairs study, the number of unique prostate cancer cases in Air Force veterans skyrocketed between fiscal years 2000 and 2018 by 195 percent[1]. While other data suggests that cases of prostate cancer were not significantly different between pilots and non-pilots, the logistics of pilot testing, including when, how often and the technologies used, remain a concern.

According to the Centers for Disease Control (CDC), high doses of radiation can lead to cancer, including prostate cancer, which is the leading cause of cancer death among men of all races and populations[2].

Currently, the military’s health care system covers prostate cancer screenings at age 50 for service members with no family history of the disease, and as young as age 40 if there is a family history of the disease in two or more family members and based on the shocking number of cancer cases in former Air Force pilots, now is the time to bring new screening technologies to the market.

The most common prostate screening is a PSA test, which measures the amount of prostate-specific antigen (PSA) in your blood. PSA is a protein produced by both cancerous and noncancerous tissue in the prostate, a small gland that sits below the bladder in men.

Dr. Jay Bishoff, a proponent of NuView Life Science’s breakthrough screening technology, confirmed the challenges that exist with the current PSA testing method. “Many things can cause a rise in PSA levels,” said Dr. Bishoff. “PSA testing can be faulty in that it is testing for something that can be raised by many other factors besides prostate cancer such as infection or manipulation.”

The new look of prostate cancer screening is in the works by NuView Diagnostics, a subsidiary of NuView Life Sciences. The company is developing a NV-VPAC1TM technology that may be used for detecting shed cancer cells in voided urine. The technology is an in vitro diagnostic unit dose and works by attaching a fluorophore to an NV-VPAC1TM peptide, allowing the VPAC1 to be visualized microscopically with cancer cells becoming illuminated when viewed under a confocal microscope.

Due to the simple and convenient nature of the NV-VPAC1 urine screen diagnostic test, it has the potential to complement or simply replace the PSA test as part of routine screening of prostate cancer.

“Prostate cancer is the number one killer of men,” Crowe said. “We need to look at these alternative ways to effectively diagnose and treat those with disease.”

Leadership Council on Legal Diversity Reaches 10,000 Diverse Attorneys in First Ten Years

The Leadership Council on Legal Diversity, an organization made up of 337 corporate general counsel and the managing partners of the nation’s leading law firms, marked its ten-year anniversary by announcing that its programs have helped advance the career paths of more than 10,000 diverse attorneys and law students.

“10 years. 10,000 careers,” said LCLD President Robert J. Grey, Jr.

“We are, of course, tremendously proud of hitting—and surpassing—that number,” said Grey, “but there’s another number that’s absolutely critical to the success we’ve seen, and that’s the number ‘one.'”

“We are advancing careers, one by one…and we’re able to do that only because of the personal and individual commitment of each one of the general counsel and managing partners who make up LCLD.”

LCLD’s initiatives include a national mentoring program for diverse law students, a 1L Scholars program providing summer experience at law firms and in corporate legal departments for first-year law students, a Pathfinder Program for law firm associates and rising attorneys within corporate legal departments, a Fellows Program for law firm partners and in-house attorneys with eight to 15 years of experience, and an Alumni Program which provides support throughout a Fellow’s and a Pathfinder’s career.

LCLD announced that it hit its target of reaching 10,000 diverse attorneys and law students at its tenth annual meeting in Washington, D.C. Sept. 23-24.

“There is no silver bullet or magic formula for success with diversity and inclusion,” said Grey. “Progress has to be more than incremental and made up of many different ideas, both big and small, but it can be scalable. Our job is to find the best ideas and give them a platform, on our website, through social media, and at national and regional meetings.”

Success is also contagious, he said. As example, he cited a multi-year LCLD “Sustainable Partnerships” program in the Washington, D.C. area which gave diverse law firm attorneys multiple exposures to general counsel. The program, which encourages the building of diverse teams, making client pitches, and cultivating potential clients, has now spread to the San Francisco area.

“This is a textbook example of how a good idea can take root and spread,” said Grey.

“I think we’ll see continuing progress with diversity numbers,” he said. “But what is really happening is below the radar.” There is, he said, a national network of 1,600 LCLD Fellows who support one another, challenge each other, share candid advice, and refer business to one another. And that national network is growing exponentially, year by year, said Grey.

“This sets the stage for the next ten years,” said Grey, “as LCLD Members work to identify the critical points in the operations and processes of law firms and corporate legal departments. This next decade will see strategies to remove barriers, improve organizations’ processes, and build on what’s working.”

“The Members have seen the pace-setting work done by the Board over these first 10 years and have maintained an annual membership renewal rate of more than 95%, a reflection,” said Grey, “of the membership’s commitment to stay in this thing for the long haul.”

“And I am encouraged by the fact that diversity is exemplified by the Board’s first four chairs: An African American male, a Caucasian female, a Hispanic male, and a Caucasian male.”

“This generation of leaders in the law has taken on the responsibility for innovation and persistence and challenging their organizations to create, as former LCLD Chair Brad Smith once put it: “a profession as diverse as the nation we serve.’”
