FSHD Society to Hold Landmark “Voice of the Patient” Meeting

Input from patients can inform the FDA’s decisions and oversight both during drug development and during its review of a marketing application.

The FSHD Society announced today that the U.S. Food and Drug Administration (FDA) has approved its application to hold an externally led Patient-Focused Drug Development (EL-PFDD) meeting on facioscapulohumeral muscular dystrophy. This meeting, a key component of the Society’s Therapeutic Accelerator initiative, has been scheduled for April 21, 2020, in College Park, Maryland. The Muscular Dystrophy Association and Friends of FSH Research will be supporting and participating as well.

The PFDD meetings, started in 2012 by the FDA, are used to obtain patient perspectives on specific diseases and their treatments. The demand from disease advocacy groups to have the meetings quickly exceeded the agency’s capacity, and so the FDA set up a mechanism for groups to apply to organize “externally led” PFDD meetings.

According to the FDA, “PFDD meetings give FDA and other key stakeholders, including medical product developers, health care providers, federal partners, an important opportunity to hear directly from patients, their families, caregivers, and patient advocates about the symptoms that matter most to them, the impact the disease has on patients’ daily lives, and patients’ experiences with currently available treatments. This input can inform FDA’s decisions and oversight both during drug development and during our review of a marketing application.”

The FSHD Society’s EL-PFDD meeting will provide individuals with FSHD, caregivers, and other stakeholders an opportunity to share their experiences and preferences so that the FDA and the biopharmaceutical industry can:


  • understand the FSHD patient journey, and recognize patient preferences and risk tolerance so these may be translated into improved clinical trial designs, selection criteria, and development of outcome measures relevant to FSHD drug development;
  • demonstrate the complexity and heterogeneity of FSHD, with the end goal of development programs and trial designs that will reflect these aspects of the disease;
  • create a practical, scientifically rigorous framework that incorporates patient preferences and patient-reported outcomes into FSHD clinical research to ensure that trials are measuring not only statistical success, but also demonstrating meaningful benefit to individuals with FSHD;
  • better understand patient and caregiver perceptions about the treatments they are currently using, which treatments are most beneficial, and which ones may have side effects;
  • encourage identification and use of approaches and best practices to facilitate patient enrollment and minimize the burden of patient participation in clinical trials; and
  • ensure that people with FSHD understand the value of their participation in clinical trials, and how their input impacts FDA and biopharmaceutical industry decision-making and outcomes at all levels to both improve their own health-related quality of life as well as that of others with FSHD, now and in the future.

Prior to the meeting, the FSHD Society plans to distribute online surveys to some 3,500 patients and family members in its contact database, as well as more than 5,000 members of various FSHD-focused Facebook groups. In addition, the Society will collect patient comments over its social media channels and conduct in-person focus group discussions through its national chapter program and Family Day conferences.

“Data from these surveys and other methods will be used to shape the content and selection of panelists for the April meeting,” explained June Kinoshita, Chief Strategic Programs Officer of the FSHD Society. “We urge patients and caregivers who want their voices to be included in this process to make sure they are on the Society’s mailing list.”

FACT’s New God-Given Marriage Initiative Challenges Major Supreme Court Ruling

By ignoring this provision in Tennessee’s Constitution the previous administration cast a cloud of legal doubt over the legal validity of every marriage license issued to two people of the same-sex since the Obergefell decision and the marriage based on that license.

Today marks the launch of a new initiative from The Family Action Council of Tennessee (FACT) that challenges the way Tennessee’s elected officials have applied the “right to marry” holding in the U.S. Supreme Court’s 2015 Obergefell v. Hodges decision to Tennessee’s marriage licensing statutes. FACT is the first organization in Tennessee or in the nation to formally challenge the constitutional limitations of the holding in Obergefell.

The initiative, God-Given Marriage, is an educational campaign to help Tennesseans and all Americans understand not just the societal implications of the Obergefell decision, but also the limits of the federal judiciary’s power in enforcing 14th Amendment rights.

This initiative will raise a number of critical constitutional issues created by the holdings of the U.S. Supreme Court’s opinion in Obergefell v. Hodges regarding a 14th Amendment marriage that local officials and the previous gubernatorial administration ignored.

FACT President David Fowler said, “It’s a fact that the Supreme Court forgot to explain how people were supposed to exercise their right to this new 14th Amendment understanding of marriage.”

Fowler continued, “The Court seemed to assume that the states would provide a license by which people would enter into a 14th Amendment marriage, but it is a legal fact that no state law and no judicial holding has ever authorized any state or local official to issue a license for a 14th Amendment type of marriage. The previous administration acted as if the U.S. Supreme Court now can create state laws through its holdings and told our county clerks to act accordingly. It’s constitutionally impossible for a federal court to create a law for a state.”

“It is also a legal fact that no court has ever enjoined the enforcement of the provision in Tennessee’s Constitution that says, ‘Any policy, law, or judicial interpretation purporting to define marriage as other than the historical institution and marital contract between one man and one woman . . . shall be void and unenforceable.’ By ignoring this provision in Tennessee’s Constitution the previous administration cast a cloud of legal doubt over the legal validity of every marriage license issued to two people of the same-sex since the Obergefell decision and the marriage based on that license. The language of the Tennessee Constitution, never enjoined by any court, is very clear,” Fowler added.

However, according to Fowler, the fundamental question this initiative raises is whether marriage is an institution given to us by government or whether it is given to us by God.

“The majority in Obergefell was very clear in stating that the Court was dealing with ‘enacted law and policy,’ and they clearly stated that their opinion should not be read to ‘disparage’ other understandings of marriage,” he said. “This initiative takes the U.S. Supreme Court at its word and will put this fundamental question as to the source of marital rights to the governor and the Tennessee General Assembly by means of a new legislative proposal.”

To put marriage back in the hands of men and women of Tennessee and take the creation and definition of marriage out of the hands of the federal government, particularly the U.S. Supreme Court, the initiative will commend to the governor and General Assembly the Marital Contract at Common Law Recording Act for enactment during the 2020 legislative session.

Tennessee voters weighed in on the issue of marriage in 2006. That year eighty-one percent of the votes cast were in favor of an amendment to the Tennessee Constitution that recognized that marriage was a pre-political relationship between one man and one woman as opposed to one created by legislative enactments. A recent scientific poll conducted by FACT showed that 74 percent of Tennesseans think the federal government should stay out of Tennessee marriages.

California Governor Signs Bill Making Autism Service Providers Mandated Reporters

Children with autism may not always be able to advocate for themselves, so it’s imperative that all individuals who provide services to them are trained to recognize and report suspected abuse.

California Governor Gavin Newsom has signed Assembly Bill 189, a bill authored by Assembly Member Sydney Kamlager-Dove (D – Los Angeles) and co-sponsored by the Center for Autism and Related Disorders (CARD). The bill, which adds autism service providers to the state’s list of individuals who are mandated reporters, received overwhelming support from both the California Assembly and Senate.

By making qualified autism service providers, professionals and paraprofessionals mandated reporters, AB 189 makes it a crime for these individuals not to report suspected child abuse or neglect.

“Children with autism may not always be able to advocate for themselves, so it’s imperative that all individuals who provide services to them are trained to recognize and report suspected abuse,” said Assembly Member Kamlager-Dove.

“We are so thankful for Assembly Member Kamlager-Dove’s dedication to California’s autism community,” said Doreen Granpeesheh, Ph.D., BCBA-D, chief executive officer and founder of CARD. “Children with autism are at a higher risk for abuse, so it’s critical for those who provide services to these children to be trained to recognize and report abuse.”

California is home to more autism treatment providers than any other state, and the field of autism treatment continues to grow to meet the needs of individuals diagnosed with autism spectrum disorder. The Child Abuse and Neglect Reporting Act (CANRA) will now explicitly require autism treatment providers and their clinical employees to report suspected incidents of abuse or neglect.

According to Assembly Member Kamlager-Dove, “Mandated reporter laws are in place to prevent children, along with at-risk individuals, from being abused and to end abuse or neglect at the earliest possible stage. Adding qualified autism service providers to the list of individuals who are mandated reporters under CANRA will help to protect children on the autism spectrum.”

Autism treatment providers will be required to provide their clinical employees with a statement informing them of their mandated reporter status and explaining their obligations to report suspected child abuse and neglect. To make a report, a mandated reporter must immediately contact the appropriate law enforcement agency. The new law takes effect January 1, 2020.

World’s Greatest (Photoshop) Dad Shows What Kids Do When Nobody’s Looking

It’s the secret lives of babies, and we’ve never seen them so clearly.

The last time the world saw Hannah Crowley, she was an infant perched above a lake, dangling from a banister, steering a car and making parents everywhere lose their collective minds.

Her father Stephen’s Photoshop skills made the images possible. Now he and Hannah are back, working on a new project to help kids facing real-life danger.

In 2017, Hannah was emerging from hospitalization and treatment for a rare immune disorder, which involved chemotherapy and a bone marrow transplant. Stephen took photos of her out and about for the first time, and edited her into mischievous scenes to entertain their family. He shared the photos on Reddit and soon after, Mashable, CBS News, BuzzFeed, The A.V. Club and other news outlets came calling.

Today, Hannah is a healthy preschooler and “the happiest kid in the world,” said Stephen. “She could not have made a more perfect recovery.”

Baby gear brand Summer remembered Stephen’s design wizardry and asked him to team up on a project. Summer wanted to showcase the high resolution of its new Baby Pixel Zoom HD video baby monitor by revealing what babies do when nobody’s looking.

Stephen created a series of new images that would make any parent drop their can of White Claw and run for the nursery.

“It’s the secret lives of babies, and we’ve never seen them so clearly,” said Summer VP Brand Marketing Jen Johnson.

“Caught in the Act” shows a baby scaling a shelf to reach a toy, escaping her crib and perched on the family dog – all from a baby monitor’s perspective.

For the shoot, Stephen enlisted the best photo assistant he knew: Hannah.

In the video trailer, Hannah, now 4 years old, can be seen assembling props, wearing her dad’s camera and helping him line up the perfect shot with a friend’s daughter.

ASGCT Presents Career Development Awards to Six Members


ASGCT’s Career Development Awards support independent transformative pilot studies in gene and cell therapy conducted by ASGCT members, particularly those ideas that would be challenging to fund with normal funding mechanisms.

The American Society of Gene and Cell Therapy (ASGCT) has selected six members to receive $50,000 Career Development Awards, a total distribution of $300,000. This group of awardees is ASGCT’s second class of Career Development Award recipients, a program in which ASGCT recognizes members who are transitioning toward independence in their careers.

ASGCT’s Career Development Awards support independent transformative pilot studies in gene and cell therapy conducted by ASGCT members, particularly those ideas that would be challenging to fund with normal funding mechanisms. The Society is also interested in helping applicants generate preliminary data to use in larger proposals (NIH K awards, first-submission R-level funding, etc.). The recipients were chosen by a selection committee made up of industry leaders identified by the ASGCT Board of Directors.
