PLAINTIFFS hereby seek recovery of civil penalties as prescribed by the Labor Code Private Attorney General Act of 2004 as the representatives of the State of California for the illegal conduct perpetrated on PLAINTIFFS and the other AGGRIEVED EMPLOYEES.

PAGA is a mechanism by which the State of California itself can enforce state labor laws through the employee suing under the PAGA who do so as the proxy or agent of the state’s labor law enforcement agencies. An action to recover civil penalties under PAGA is fundamentally a law enforcement action designed to protect the public and not to benefit private parties. The purpose of PAGA is not to recover damages or restitution, but to create a means of “deputizing” citizens as private attorneys general to enforce the Labor Code.

Dan and Wendy live in Lee’s Summit. They have two married daughters – Lyndsi and Chris McCale and Courtney and Jimmy Powell – as well as a son, Brian Calvert, and six grandchildren. They both have corporate backgrounds in project management – Wendy in construction and Dan in construction and e-commerce. Dan was semi-retired but, when Wendy’s company downsized, they decided it was time to start their own business journey together.

“We were looking into franchising opportunities when we learned about Caring Transitions. I went through moving my parents from a large home into a small assisted living apartment and it was extremely painful. When I started researching Caring Transitions, I got really impassioned. I understand the role Caring Transitions can play and the difference these services can make for families. We’re looking forward to being a resource and a solution for people in this community who are facing these kinds of transitions,” Wendy said.
