Know Your Rights as a Consumer Regarding Chargebacks, COVID-19 Travel Cancellations

Countless consumers have already paid via credit card for flights and hotel stays that may never happen.

This is a complex, time-consuming process and the sheer volume of cases will compound that exponentially. Over the long run, however, it will be worth the effort, in terms of both recovered revenue and sustainability.

Air travel, radically curtailed by the onset of the coronavirus pandemic, began recovering somewhat in May; however, the number of passengers passing through airport security checkpoints on the busiest day of that month amounted to only 14% of the travel volume on the equivalent day in 2019.(1) As to the hotel industry, recent research from McKinsey & Company suggests that recovery to pre-COVID-19 levels could take until 2023—or later.(2) “Much of this reduction in travel volume,” says Monica Eaton-Cardone, an entrepreneur and IT executive specializing in risk management and fraud prevention, “represents the cancellation of prepaid reservations. The industry needs to do everything it can to mitigate resulting chargeback losses.”

Underscoring the importance of this advice, says Eaton-Cardone, is the extremely serious situation facing the overall travel and hospitality sector. In May, both American Airlines and Delta announced imminent reductions in workforce through both voluntary exit programs and layoffs.(3) In early August, Hilton Worldwide Holdings announced revenue of $564 million for the second quarter, down 77.3% from the second quarter of 2019.(4)

Countless consumers, Eaton-Cardone notes, have already paid via credit card for flights and hotel stays that may never happen. Plane tickets or rooms purchased with a credit card, she points out, give the customer the option of filing a chargeback if the carrier goes under. However, in the case of multiple bankruptcies of large companies, there may be no one to whom the acquirer can pass along the bill, and acquirers have already started taking legal steps to mitigate their risk.

Tips and Rights

  • If you had to cancel a travel reservation, before you solicit a refund and/or file a claim with your credit institution, speak with the travel company. There may be options that appeal to you. Speaking directly with a company is always a good idea and should be the first step.
  • The U.S. Department of Transportation reports that airlines are obligated to offer refunds—the ticket price and any cancellation fee. If they do not, file a report with the department.
  • Every consumer has the right to dispute a credit charge—whether it’s as a result of a COVID-19 cancellation issue or not. As old-fashioned as it may sound, your best bet is to send the creditor a letter describing the dispute. Include all pertinent information and send the letter by certified mail with a return receipt. Keep all documents.
  • The Federal Trade Commission (FTC) enforces the Fair Credit Billing Act (FCBA) for most creditors—except banks. If you think a creditor has violated the FCBA, file a complaint with the FTC.

To encourage card use and retention—and wherever possible to encourage consumers with paid reservations to stay the course until normal travel resumes—some premium card issuers have announced new perks and offerings such as statement credit on select U.S. streaming video and wireless telephone services, the ability to use travel credit at gas stations and grocery stores, and the use of travel credit at restaurants.(5)

This, however, says Eaton-Cardone, probably represents more of a holding action than a solution. For airlines and hotel companies, she counsels that the best move is to prevent as many chargebacks as possible by working closely with consumers to resolve the situation. For customer disputes that do get filed, however, she says that merchants should challenge all that could be proven invalid.

“This is a complex, time-consuming process,” says Eaton-Cardone, “and the sheer volume of cases will compound that exponentially. Over the long run, however, it will be worth the effort, in terms of both recovered revenue and sustainability.”

How to Build Self Control to Outperform in Your Professional and Personal Life

“The self-controlled person will take those steps and follow through on them. These things can appear scary, but don’t worry, you’re not alone. And once you take the first step, you have ventured onto a beautiful path that offers many rewards.”

Self-control is the ability to motivate and coordinate our efforts to improve our quality of life, but unfortunately, most people are not taught it. “Self-control is an undervalued trait in a modern society that wants everything now,” says Carter, co-author with his wife, Dr. Kirti Salwe Carter, of The Morning Mind: Use Your Brain to Master Your Day and Supercharge Your Life (

Carter offers five ways to develop self-control:

1. Be aware of your resistance. Resistance, Carter says, is the biggest obstacle to developing self-control, and it often comes in the form of discouraging internal self-talk such as, “I can’t do it” or “Why should I have to change?” “The next time you embark on a new project that causes resistance,” Carter says, “fight it by asserting or writing down your intended goal and the benefits it will bring.”

2. Plan for every outcome. Plans go awry when people let excuses get in the way. “An example is having a goal of running in the morning for 20 minutes, but you have bailouts such as it’s raining, cold, or you don’t feel like it,” Carter says. “Developing self-control is recognizing and planning for these self-created obstacles and actively choosing to work through them.”

3. Prepare to give something up in order to gain. Carter suggests compiling a list of the pros and cons of sacrificing for a certain goal. “To reach your goal, Carter says, “you will more than likely have to impose certain limitations on yourself in order to gain something.”

4. Reward yourself with self-compensation. “Rewards are an incredibly powerful tool for motivating yourself to reach your goals,” Carter says. “Consider them the carrot on the stick. Have a reward in place for when you achieve a goal or part of a goal, and make sure it’s appropriate.” Moderation and self-control are frequently associated with deprivation. However, self-control actually contributes to happiness and better goal attainment.

5. Break your goal down into manageable steps. “If you break your goal down into bite-sized steps,” Carter says, “you’re much more likely to stay disciplined enough to complete every sub-goal. Each step accomplished gives you an encouraging boost. Consider using SMART goals — specific, measurable, attractive, realistic, timed. This makes the goal more definitive and puts the steps in tangible action.”

“Self-control includes structured planning, organization, delayed gratification, and the willingness to step outside your comfort zone,” Carter says. “These things can appear scary, but don’t worry, you’re not alone. And once you take the first step, you have ventured onto a beautiful path that offers many rewards.”

Fierce Conversations Launches Conversation Catalysts Program To Share New Voices With Diverse Perspectives

Fierce Conversations today announced Conversation Catalysts, a new program that aims to highlight new and timely perspectives with access to content from expert contributors, commentators, and influencers in their given field. Fierce’s first Conversation Catalysts are Karith Foster, author speaker and humorist, and Dondré Whitfield, author, actor, social commentator and speaker.

“Conversations are at the heart of every aspect of our lives — both at work and at home, and there is a need now more than ever to elevate these timely conversations, provoke learning, and enrich relationships,” said Ed Beltran, CEO of Fierce. “By listening and injecting diverse perspectives and voices into the workplace, and into the larger world, we hope to expand knowledge and understanding while providing the tools to make a real impact.”

Since its inception, Fierce has maintained that what gets talked about, how it gets talked about, and who is invited to the conversation determines what will happen, and what won’t happen. By sharing diverse voices, Fierce hopes individuals can have provocative conversations that will help open minds to new perspectives — both in work and in life.

To kick off this new initiative, Fierce is launching the first two Conversation Catalysts:

  • Karith Foster: Karith is a Stand-up comedian, motivational speaker, TV and radio personality, actress, author and entrepreneur, named “one of the hottest comics to come out of New York City” according to both The Hollywood Reporter and Backstage Magazine. She has appeared on Oprah, BRAVO, BET, Comedy Central’s Premium Blend, NBC’s Today Show, and Last Comic Standing. Karith has transitioned her comedy into a speaking career in the areas of diversity, leadership, women, team building and motivation. She is the author of “Laugh Your Way to Happiness: 101 Ways to Have a Great Laugh” and the soon to be released children’s book “Lealah Finds Love.” Fierce has joined forces with Karith to co-develop a powerful virtual keynote that combines skills and actionable tools to educate and cultivate a sincere comprehension of modern-day diversity.

“At this time in our collective history, feelings of division and polarization are at unprecedented heights and taking a toll on critical relationships, both personal and professional,” said Karith. “I’m excited to collaborate with Fierce Conversations on a keynote that will inspire teams to think and speak differently about Diversity and Inclusion as there has never been a greater or more immediate need for compelling communication.”

  • Dondré Whitfield: Dondré is a three-time Emmy and NAACP Image award nominee who has appeared with such celebrated actors as John Travolta, Helen Mirren, David Oyelowo, Michael B. Jordan and Kevin Hart among many others. Off-camera, Whitfield is passionate about helping address the challenges and pressures of masculine identity in the 21st century. He co-created The Manhood Tour, a global movement committed to awakening the consciousness of men, giving them the keys to effective and impactful leadership, and teaching them how to tap into their talents and live to the highest degree. Members of the Fierce Leadership team will host a an exclusive virtual panel with Dondré on September 24th, from 11AM – 12PM PDT to discuss how males in leadership roles are failing across the board.
