The San Diego labor law attorneys at Blumenthal Nordrehaug Bhowmik De Blouw LLP filed a class action lawsuit against Hy-Lang Electric California, Inc., alleging the company failed to pay accurate wages, failed to provide required meal and rest breaks, and was in violation of the Private Attorneys General Act. The Hy-Lang Electric California, Inc. lawsuit, Case No. 37-2020-00012543-CU-OE-CTL, is currently pending in the San Diego County Superior Court for the State of California. According to the class action complaint’s allegations, Hy-Lang Electric California, Inc. failed and continues to fail to accurately calculate and pay PLAINTIFF and the other members of the CALIFORNIA CLASS for their overtime worked. DEFENDANT also failed to record and pay employees for the actual amount of time worked, meaning the time during which an employee was subject to the control of an employer. Additionally, as a result of their rigorous work schedules, PLAINTIFF and other CALIFORNIA CLASS Members were from time to time unable to take of duty meal breaks and were not fully relieved of duty for meal periods. The lawsuit also alleges DEFENDANT failed to reimburse for required business expenses incurred by PLAINTIFF. Under California Labor Code Section 2801, employers are required to indemnify employees for all expenses incurred in the course and scope of their employment.
PAGA is a mechanism by which the State of California itself can enforce state labor laws through the employee suing under the PAGA who do so as the proxy or agent of the state’s labor law enforcement agencies. An action to recover civil penalties under PAGA is fundamentally a law enforcement action designed to protect the public and not to benefit private parties. The purpose of PAGA is not to recover damages or restitution, but to create a means of “deputizing” citizens as private attorneys general to enforce the Labor Code.
