The Los Angeles labor law attorneys at Blumenthal Nordrehaug Bhowmik De Blouw LLP filed a class action lawsuit against Health Net of California, Inc., alleging the healthcare solutions provider failed to properly classify employees, failed to provide accurate itemized wage statements, and failed to provide required meal and rest periods. The Health Net of California, Inc. lawsuit, Case No. 56-2020-00540550-CU-OE-VTA, is currently pending in Ventura County Superior Court for the State of California. The complaint alleges PLAINTIFF and the other CALIFORNIA CLASS members were misclassified as exempt from California overtime and related laws by DEFENDANT, however these employees did not have managerial duties or authority. Although the PLAINTIFF and other Marketing Specialists primarily performed non-exempt clerical labor, DEFENDANT instituted a blanket classification policy. PLAINTIFF and the CALIFORNIA CLASS members employed by DEFENDANT were not primarily engaged in work of a type that was or now is directly related to the management or general business operation of the DEFENDANT.
Additionally, DEFENDANT from time to time allegedly violated Cal. Lab. Code § 226 by failing to provide wage statements that identified the correct gross and net wages earned. Cal. Lab. Code § 226 provides that every employer shall furnish each of his or her employees with an accurate itemized wage statement in writing showing, among other things, gross wages earned and all applicable hourly rates in effect during the pay period and the corresponding amount of time worked at each hourly rate. The lawsuit also alleges DEFENDANT failed to provide all the legally required off-duty meal and rest breaks to the PLAINTIFF due to not having a policy or practice in place which provides meal and rest breaks to employees.
