Compound Solutions Inc. and Axcess Global Sciences win in court against New U Life

Our IP is strong and growing. The verdict in the New U Life case is vindication, as well as a clear message to all partners that we’ll defend our IP.

Axcess Global Sciences (AGS) owns BHB Patent No. 6,613,356. New U Life Corporation widely publicized its challenge to the BHB Patent and lost.

  • Certain Exogenous Beta-Hydroxybutyrate Nutraceutical Products, Docket No. 3400 (United States International Trade Commission, filed July 24, 2019).
  • New U Life Corporation v. ITC, Docket No. 2020-1214 (United States Court of Appeals for the Federal Circuit, filed Dec. 6, 2019).

The Federal Circuit Action has dismissed New U Life’s case with prejudice. “With prejudice” means the ruling is final, and New U Life has potential liability for the defendant’s attorney’s fees and financial damage.

Over the last two years, Compound Solutions (CSI) and Axcess Global Sciences (AGS), partners in patented goBHB®-branded beta-hydroxybutyrate, have vigorously defended goBHB®’s intellectual property from suppliers and marketers trying to capitalize on the growing ketogenic market.

Rob Rogers, one of the founders and managing partners of AGS said, “Our IP is strong and growing. The verdict in the New U Life case is vindication, as well as a clear message to all partners that we’ll defend our IP. We’re open for business, so please reach out to Compound Solutions to use our patented goBHB®.”

Past violators in question have marketed their ketone products in direct violation of Patent No. 6,613,356, which is exclusively licensed by CSI and sold as branded goBHB®. CSI and AGS worked with those violators and ultimately reached agreements that converted defendants into new customers.

Matt Titlow, CEO of CSI, said, “We’re proud to say we’re partners with those we’ve settled with. We’re here to say that our competitive pricing, goBHB® brand, patent and business-friendliness enable our partners to thrive.”

Compound Solutions’ goBHB is the world’s best-selling patented BHB. Compound Solutions has a long history of working with its partners to strongly defend intellectual property (IP). Customers trust CSI to defend IP and provide unique ingredients customers can successfully market to end-consumers.

Rogers added: “We now have 13 granted patents in the ketone space. We’re invested for the long term.”

Customers working with branded and patented goBHB® are assured the material is regulatorily-compliant, self-affirmed GRAS, Informed-Choice/Informed-Sport certified, and patent-protected. Furthermore, CSI’s goBHB manufacturer has registered the ingredient with local regulatory agencies, invested millions in tight pollution control, and successfully passed an FDA-audit. The factory is NSF-certified. These quality assurances are not found with generic BHBs.
