The Cybersecurity Act of 2015 (CSA), Section 405(d), established an industry-led process to develop consensus-based guidelines, practices, and methodologies to strengthen the healthcare sector’s cybersecurity posture against cyber threats. This effort led to the development of the https://405d.hhs.gov/Documents/HICP-Main-508.pdf, which identifies ten practices that are tailored to small, medium, and large organizations.
With the passing of https://www.govinfo.gov/content/pkg/PLAW-116publ321/pdf/PLAW-116publ321.pdf (HR 7898) in early 2021, Congress underscored the importance and value of 405(d) HICP by requiring the Secretary of Health and Human Services to consider it among the recognized security practices of covered entities and business associates when determining fines and penalties related to a breach of protected health information. Evidence that recognized security practices are in place may be requested in regulatory inquiries and investigations. Additionally, some investors, cyber insurers, and other third parties have begun requiring that healthcare organizations they contract with demonstrate adoption of recognized security practices.
