Zakay Law Group APLC and JCL Law Firm APC File Class Action Against Catholic Charities Alleging Failure to Provide Meal and Rest Breaks

As a result of their rigorous work schedules, Catholic Charities’ employees were allegedly unable to take off duty meal breaks and were not fully relieved of duty for meal periods. Specifically, the lawsuit alleges employees were from time to time interrupted during their off-duty meal breaks to complete tasks for Navy Federal Credit Union. Employees were allegedly required to perform work as ordered by Catholic Charities for more than five (5) hours during a shift without receiving an off-duty meal break. Further, the lawsuit alleges Catholic Charities failed to provide employees with a second off-duty meal period each workday in which these employees were required by Catholic Charities to work ten (10) hours of work. Catholic Charities’ policy allegedly caused employees to remain on-call and on duty during what was supposed to be their off-duty meal periods. Employees therefore allegedly forfeited meal breaks without additional compensation and in accordance with Catholic Charities’ strict corporate policy and practice.

Consumer Advocates Warn Lawsuits Will Hurt Home Buyers, Circumvent Fair Housing Laws

NAEBA members have always embraced greater transparency and consumer choice. They caution a prohibition against seller agents paying buyer agents commissions is anti-consumer, leading to fewer home buyers retaining representation and more dual agency. Dual agency is when the same real estate agent or brokerage represents the buyer and the seller in the transaction.

“A system that makes it harder for first-time and lower-income home buyers to retain loyal representation won’t save home-buying consumers money,” NAEBA president Rich Rosa said. “The lack of trusted representation will lead to costly mistakes, ultimately costing home buyers more money.”

Another lawsuit also calls into question the rule requiring REALTOR® members who list properties in alternative databases to list the properties on an MLS. Sellers, of course, can choose not to list with a REALTOR® and avoid the MLS entirely.

NAEBA believes calls for dismantling rules requiring REALTOR® members to list all advertised properties on the MLS are dangerous. Allowing REALTORS® to bypass their local MLS for alternative platforms, encouraging what is known as a “pocket listing,” could lead to sellers and agents circumventing Fair Housing laws and opening the door to disparate treatment of protected classes. At a minimum, it severely limits a seller’s exposure of their home to the marketplace and more than 1.5 million REALTORS®, potentially costing sellers a lower sale price.

“Why would any seller want to limit exposure of their listing to home buyers,” Rosa said. “A seller doesn’t have to use a REALTOR® or any real estate agent, but real estate professionals should not encourage ‘pocket listings’ and limit which consumers see homes for sale.”

ABOUT NAEBA

Members of the nonprofit National Association of Exclusive Buyer Agents (NAEBA) believe there is a better way of working in the real estate industry. Unlike traditional agents, NAEBA members voluntarily dedicate their careers to exclusively representing home buyers, providing full fiduciary-level duties to protect home-buying consumers.

Exclusive buyer agents are 100 percent loyal to home buyers 100 percent of the time and work at real estate brokerages that do not ever represent home sellers. NAEBA members are also committed to promoting fair housing, eliminating discrimination, and steering in housing to ensure equal opportunities for all individuals.

NAEBA members do not accept listings, advertise properties for sale, or represent home sellers; therefore, its members avoid the conflicts of interest common at traditional real estate companies, which attempt to represent both buyers and sellers in the same transaction.

Consumer advocates created NAEBA in 1995 to fill the void faced by homebuyers and started a professional association that would provide home buyers with a higher standard of ethics.

Steel Sports Foundation Announces Donation in Partnership with Dunmore to Support Local New Jersey Youth Football Association

Bryan Wilson, a former linebacker with the NFL’s Washington Commanders and a current Dunmore employee, identified this significant opportunity to provide essential support to the Burlington City community. Wilson, who also played football at Morgan State University where he held the NCAA record for forced fumbles in a season, knows the impact sports and coaching had on his life.

“I owe much of my NFL journey to the coaches who instilled the values of Teamwork, Respect, Integrity, and Commitment in me,” Wilson said. “These same values have been instrumental in my ascent to a leadership role at Dunmore.”

In addition to the $25,000 donation, all Burlington City Youth Football Association coaches will receive access to the Steel Sports Coaching System’s Foundations of Positive Coaching 1 online course that provides support for children during their crucial developmental stages. The Steel Sports Coaching System is a unique platform that guides how to coach for maximum impact on and off the field through building character and leadership skills along with teaching life lessons. Since its development, the Coaching System has impacted nearly 20,000 athletes annually with over 1 million hours of on-field coaching.

Sports and dedicated coaching are pivotal in nurturing the positive growth and development of young student-athletes. Introducing Steel Sports’ invaluable Coaching System at this critical juncture in these kids’ lives will contribute to shaping the future’s outstanding leaders.

“Through our shared Kids First philosophy at Dunmore and Steel Partners, we are proud to support the Steel Sports Foundation in its mission to provide opportunities for young athletes to develop their skills and build character through sports,” Dunmore president Ronn Cort said. “When Bryan presented this opportunity, we knew it was the right thing to do. We are excited to work with the Burlington City Athletic Association to help make a difference for the kids and coaches in their football league. We want to help keep the young players as safe as possible out on the field, and we want them to have a positive and fun experience so they continue to play and gain the life lessons that will make them successful in life.”

The Steel Sports Foundation is committed to helping young people reach their potential through sports. The Foundation provides scholarships for athletes to attend camps, clinics, and other events, as well as supports youth sports programs across the country.

“Player safety is paramount in all levels of football, but the equipment costs can add up quickly and become a burden for many,” Steel Sports Foundation board president Mario Marcon said. “We are thrilled to be working with Dunmore to impact their local Burlington City Youth Football Association families and help provide the proper equipment they need for their kids to play the game they love.”

The Steel Sports Foundation’s board, which consists of Marcon, former Major League Baseball player and manager Bobby Valentine and Basketball Hall of Famer Ann Meyers Drysdale, is grateful for Dunmore’s commitment to help their local community and impact players, families and coaches.

Wisconsin Historical Society Granted Authority to Construct New History Center

The new 100,000-square-foot, five-story history center will utilize the site of the former Wisconsin Historical Museum as well as two adjacent properties at 20-22 North Carroll Street on Madison’s Capitol Square. The facility is expected to welcome more than 200,000 guests annually and double the number of school students served to 60,000. The center will house three permanent galleries, a rotating community gallery sharing local history from across the state, and a changing gallery large enough to bring in the nation’s most sought-after traveling exhibits. The Society will offer robust public programming throughout the communal spaces, while extending the center’s resources across the state through advanced technology.

“I am also glad to see the approval of funding for the construction of a new facility for the Wisconsin History Center on Capitol Square, which will help ensure this important Wisconsin institution remains a hub of statewide history, education, and outreach for future generations,” said Wisconsin Gov. Tony Evers, who serves as Chair of the State Building Commission.

The Society has partnered with an industry-leading architectural and exhibition design team that includes Ralph Appelbaum Associates as well as Continuum Architects + Planners and SmithGroup. Extensive collaborations with community partners, a 12-member scholarly advisory panel, the Institute for Human Centered Design and a formal Native Nations Council are also informing the final experience design.

The design and construction budget for the project will be supported by $112.3 million in State funds and $48.2 million in private gifts.

“The Wisconsin History Center is set to be a beacon for history in the Midwest, a game-changer for our kids and teachers, and a premier tourist destination,” said Rep. Rob Swearingen, Vice Chair of the State Building Commission. “I’m happy to support this long overdue project and excited for what’s to come!”
