Palm Beach AACFL – Divorce Lawyers Adopt Innovative Solution to Help Clients and Judges

The organization’s mission is to solve a growing problem in the divorce world – a rapidly changing economy.

The CFL™ designation has taken Palm Beach by storm with the recent launch of the American Academy for Certified Financial Litigators (AACFL) Palm Beach Chapter in December of 2019. The AACFL is proud to announce the creation of this chapter and applauds the commitment of its Founding Members. The organization’s mission is to solve a growing problem in the divorce world – a rapidly changing economy.

A common path for these attorneys is to study liberal arts at the undergraduate level, then to go to law school, and then to be fighting for their clients’ financial future without any formal financial training. The mission of this group is to fix that problem because of how complex today’s financial economy has become. A solid understanding of the financial fundamentals taught in the CFL™ Training course can make the difference between an attorney’s client struggling after their divorce and the client being able to start the next chapter of their life with more financial security for their family. While years of experience as a divorce attorney is undoubtedly valuable, imagine the power and benefit to clients of combining that legal knowledge with enhanced financial knowledge!

An additional goal for the group is to raise the level of financial knowledge in the family law community, freeing up the judge’s schedules from having to deal with these matters. This will allow judges to spend more time on areas such as domestic abuse, custody problems, and other important, non-financial, family matters. The organization believes that this is a goal that society would benefit from greatly.

The uniqueness of the CFL™ designation and training program is that it was developed by nationally recognized financial firms, financial experts, attorneys and judges who believe in the mission. To create public confidence, the CFL™ designation is only awarded to members of the AACFL who have taken the time to study and receive a passing grade on an objective, comprehensive exam covering these concepts. Not all divorce lawyers would make the commitment of time and effort to obtain and prove their knowledge in these areas. RunSafe Security Raises $6.3 Million to Immunize Software

Tennessee Ministers and Independent Baptist Organization File Petition for Declaratory Order Regarding State Marriage Certificate

The state’s definition of marriage implicates the civil rights of the ministers in regard to the liberty of conscience guaranteed to them under the Tennessee Constitution and in regard to the U.S. Constitution’s First Amendment…

Today, 11 Christian ministers from across the state of Tennessee, along with Tennessee Independent Baptists for Religious Liberty, Inc., filed a Petition for Declaratory Order with the Tennessee Department of Health and Dr. Lisa Piercey, commissioner of health, in regard to the Certificate of Marriage issued by the department. Ministers must sign the certificate if they solemnize a licensed marriage in Tennessee.

“The state’s definition of marriage implicates the civil rights of the ministers in regard to the liberty of conscience guaranteed to them under the Tennessee Constitution and in regard to the U.S. Constitution’s First Amendment promise not to prohibit the free exercise of religion and its prohibition on government-compelled speech,” noted David Fowler, general counsel for The Family Action Council of Tennessee’s Constitutional Government Defense Fund, which represents the petitioners.

Fowler said that the state has effectively conscripted ministers into administering the state’s civil law policy in regard to a licensed form of marriage and, because the state does not allow anything but “licensed marriages,” ministers must sign the department’s Certificate of Health in order for the couples whose marriages they solemnize to have even the most basic rights inherent in a marital relationship recognized.

According to Fowler, the ministers do not want to sign a government form that affirms an understanding of marriage that is contrary to what they believe and teach, but at the same time, they believe that, under God, civil rulers should ensure enforcement of the rights that naturally arise out of the obligations assumed in a marital relationship, thereby upholding societal respect for marriage.

“The civil law,” Fowler said, “puts these ministers in a position in which they may have to forego one or the other of these beliefs in the conduct of their ministry to married couples. However, if the Certificate of Marriage purports to define marriage without regard to the sex of the two parties, which appears to be the case, then the certificate itself may be ‘void and unenforceable’ anyway under the Tennessee Constitution.”

The petition notes that under former-Governor Bill Haslam, the department changed the Certificate of Marriage form following the U.S. Supreme Court’s 2015 decision in Tanco v. Haslam (a companion case to Obergefell v. Hodges involving certain Ohio laws). But the petition, quoting Federal District Court Judge Aleta Traugher and the legal arguments submitted by Tennessee’s Attorney General & Reporter Herbert Slatery, states that Judge Trauger’s Final Order and Permanent Injunction did not enjoin enforcement of the provision in the Tennessee Constitution making “void and unenforceable” any “policy, law, or judicial interpretation purporting to define marriage as anything other than the historical institution and legal contract between one man and one woman.”

Based on this, the petition asks the department and commissioner either to reinstate the Certificate of Marriage that was issued prior to the Obergefell decision or discontinue issuing a certificate until such time as the statutory requirement that marriage licenses be issued only to “male and female contracting parties” is changed in a constitutional manner.

The Department of Health and Commissioner Piercey have 60 days in which to decide what they will tell these ministers. If the department takes no action, then petitioners will be authorized by law to pursue a lawsuit against the department in state court.

Petitioners hope Governor Lee will make clear to these ministers and ministers across the state the position of his administration in regard to the effect of Judge Trauger’s Final Order on the Tennessee Constitution. Fowler said he hopes Governor Lee will not take the extreme position that the U.S. Supreme Court has the power to actually change the language in Tennessee licensing statutes when the plaintiffs in Tanco did not even sue over them.

Is it Time for Help? Knowing When Your Aging Loved One Can’t Go it Alone

For many families, the holidays are the first visit they’ve had with an aging relative in a year or longer.

Aging Life Care Professionals® across the country notice an increase of inquiry calls during and immediately after the holiday season.

Aging Life Care Association® incoming Board of Directors’ President Liz Barlowe, MA, CMC states that amidst the hustle and bustle, families should take time to observe any changes in an aging family member’s behaviors or lifestyle. These changes may vary widely. Bruises or cuts may indicate a recent fall, while a damaged car may indicate difficulty driving. “These signs show serious and immediate risk for the individual as well as others around them,” states Barlowe. “But taking stock of general, subtle signs of decline is important too.”

“For many families, the holidays are the first visit they’ve had with an aging relative in a year or longer,” says Kate Granigan an Aging Life Care Professional practicing in Boston, MA. “It’s the first time they can see that their mother’s house is more cluttered than before, or that she’s shuffling more down the hallway or has strategically placed furniture to hold onto for balance.”

Social isolation for seniors is a big concern, especially after the holidays Barlowe adds. The attention and activities around the holidays quickly fades and many aging relatives are left alone until the next big family event. “Loneliness and seclusion can be just as harmful to a senior as unhealthy habits.”

So how do you start a conversation with your loved one that they consider outside help? Granigan suggests to take the cues of what may be challenging them without confronting them. Ask questions about how their life could be easier or more enjoyable and then you can gently lead into a service you learned about to help out-source challenging tasks or to be a go-to assistant for support. “Not pressuring but leaving the door open with a ‘let’s think about it’ tone allows you to revisit the subject.”

Here are four key areas to examine during your holiday visits:

  • Environment: is there damage or disrepair around the house; are there piles of unopen mail; does the car have dents or scratches?
  • Food: is there adequate food; do you notice weight-loss or extreme weight gain?
  • Mood or behavior: do you notice increased confusion; have they given up hobbies or social outings; do you notice increased irritability or apathy?
  • Personal hygiene: do they not dress like they used to; do clothes seem unkempt or dirty; have they lost interest in personal grooming?

These are just a few warning signs that your elder loved one needs assistance. By initiating conversation and reaching out for support and information, you can help your loved ones as they navigate this new stage of their lives.

Avoid the Seven Deadly Sins When Creating a Trust, Tip Sheet by Mark W. Bidwell

Avoid the seven deadly sins of pride, sloth, lust, envy, wrath, gluttony and greed when you prepare your trust.

Mark W. Bidwell, an attorney licensed in California, identifies how to avoid the seven deadly sins in a trust. The primary purpose of a revocable trust is for the timely, economical and orderly transfer of assets when one dies. But the sins of pride, sloth, lust, envy, wrath, gluttony and greed defeat this purpose.

The first sin is pride or hubris for ruling from the grave. Instead of distribution on death, people want to control the behavior of their loved ones by restricting access or use of assets after death. This is referred to as ruling from the grave.

Ruling from the grave may be appropriate. The classic example is the drug addicted child. Any money given to the child will only go to drugs and most likely kill the child. Here detailed restrictions and safeguards are needed.

But ruling from the grave that comes not from a place of caring, but from a sense of

ego creates hardship and bitterness. The parent while living had little influence on a child. A last shot at control is on death, the withholding of assets until an event occurs; such as marriage, a college degree or birth of a grandchild. This is akin to withholding of love with the same effects.

The second sin is sloth. Trusts avoid probate of real property. But to avoid probate court the real property must be owned by the trust. A trust transfer deed must be prepared and recorded to change owners. The effort to change owners is perceived as too great of an effort and so it does not get done.

The third sin is feeding the lust of youth. Persons under 18 years of age cannot receive assets. Any distributions directly to a minor will go through probate under court supervision. While the assets are under supervision of the court they are not wasted. But at age 18, the court must release the assets to the minor. The minor then spends the assets to feed his or her lust for life.

If there is a potential distribution to a minor, the trust should have a “children’s trust” provision. A children’s trust keeps the minor’s assets under control of the trust until the child has reached an age of financial maturity, such as 25 years.

The fourth sin of envy is created by one trust when there are children from a prior marriage. Often persons in their second marriage create one trust. Typically, the trust does not provide for distribution to children on the death of the first spouse. This is because the surviving spouse needs to live on the assets of the marriage.

The children are envious and covet the assets of their parent as a rightful inheritance. The period of time from the death of the first spouse to the death of the second spouse can be a period of conflict between the step-parent and the children.

The typical trust can be changed by the surviving spouse and in the process of change, the terms of the trust are less favorable to children of the deceased spouse. Spouses with children from a prior marriage should avoid a joint trust. This means two trusts at twice the cost. But both surviving spouse and children will be protected.

The fifth sin is wrath incurred by an amendment instead of a restatement.

Amendments must be read with the original. The heirs see what they would have received and what they now receive. The situation causes wrath in the heirs who receive less and is ripe for litigation or at the very least, creates bitter resentment. Restatement replaces the entire prior document and does not waive red flags in the face of heirs.

The sixth sin is gluttony and undue influence. People will put off their estate planning until their later years. In the later years, objectivity is lost and dependency on others is created. Persons befriend the elderly in anticipation of a windfall at death. Heirs’ and friends’ gluttony for the elder’s assets only increase as the elder’s capacity decreases. Trusts and wills should be prepared while the elder has capacity. Subsequent changes should only be made judiciously when there is a substantial change in circumstance.

The seventh sin is greed. Sibling rivalries create greed for the deceased parent’s assets. One child feels entitled and wants more than the parent intended. If there are unequal distribution of assets or an entitled child, the parent should address why he or she made the decision to distributed the assets as provided in the trust or will. This can be either while the parent is living, in writing to be read after death or both.    

The primary purpose of a trust is for the timely, economical and orderly transfer of assets when one dies. But the sins of pride, sloth, lust, envy, wrath, gluttony and greed defeat this purpose. An affordable, basic trust is a wise investment when the seven deadly sins are avoided.

U.S. Fertility Rate Finally is Stabilizing

2019 Q4 U.S. Fertility Forecast

Demographic Intelligence attributes the stabilization of the birthrate to three factors.

New data from the Centers for Disease Control confirms Demographic Intelligence’s new forecast that “called the bottom” for births in the U.S. in 2020.

“For the first time in years, the total fertility rate stabilized in the second quarter of 2019,” said Demographic Intelligence Chief Information Officer Lyman Stone. “In fact, the CDC estimates that age-specific birth rates rose for every group over age 20, consistent with D.I.’s forecast for that period. Our ability to correctly forecast within-year variation in births and birth rates, even when those forecasts represent significant deviations from recent trends, speaks to the reliability of our method.”

But this apparent plateau is at a historically low mark; final 2018 data published by the CDC just before Thanksgiving shows that the nation’s fertility rate dropped 2% year over year to 1.729 births per woman.

D.I. predicts the total fertility rate will further tick down to 1.71 in 2019 and remain basically steady at 1.70 in 2020. D.I. attributes the stabilization of the birthrate to three factors:


  • The biggest cohort of Millennials is now moving toward their late twenties and early thirties, which is now the prime time to have children;
  • The share of Millennials who are marrying looks like it will tick slightly upwards;
  • Data from the American Family Survey indicates an increase in the share of women who say that it is at least somewhat likely that they will have a child in the next two years.

Stone cautions that births temporarily flattened out in 2014 and then continued their long fall. “Furthermore, many economic observers have raised worries about recession risks,” he said. “While D.I. does not forecast recessions (and does not generally share the view that a major recession is imminent), it is nonetheless important to understand that current growth conditions, which may be supportive of positive fertility decisions, will not persist forever. The stabilization of births and birth rates is a welcome change, but it remains to be seen if there will be any actual recovery from the declines in recent years.”

The Michelin Guide introduces each country’s special cuisine which also represents the country’s rich food culture. Since its first edition in 2018, Taipei is the 31th destination to have the Michelin Guide, following the big cities of Paris, New York, and Tokyo. The restaurants and chefs that were selected and those who successfully obtained Michelin stars have increased their status and reputation immeasurably.

The Michelin Guide Taipei has built a platform to showcase the food service of Taiwan to the world. Not only has it spread the fame of Taiwanese chefs, but the abundance of local produce has also drawn the attention of many internationally renowned chefs to pay a visit to the island and exchange knowledge and experiences. Chef of the 3 Michelin starred restaurant Alain Ducasse au Plaza Athénée, Alain Ducasse, once said during a visit to Taiwan: “Since Taiwan has so many natural, delicious, and nutritious ingredients, it definitely deserves the world’s attention.” Aisha Ibrahim, known as a future star chef, who once worked in the 3 Michelin starred Azurmendi Executive Chef, is also amazed by the sweetness, taste, and quality of Taiwan’s agricultural products. He even created a new menu using 90% local ingredients from Taiwan’. In the past two years, Taiwan’s overall food service industry has been thriving, attracting Michelin starred chefs and gourmet fans from all over the world to experience the local culinary culture as well as the charm of the country.

BuzzFeed’s Hit Series “Worth It” Partners With Taiwan Tourism Bureau for Three-Episode Special, “Worth It Goes To Taiwan”

BuzzFeed’s hit series “Worth It” is partnering with the Taiwan Tourism Bureau for a three-episode special, “Worth It Goes To Taiwan,” which debuted Sunday, October 13 at 8:00 am PT on the BuzzFeed YouTube channel.

Through the partnership, “Worth It” hosts Steven Lim and Andrew Ilnyckyj and cameraman Adam Bianchi will travel through Taiwan, celebrating Taiwanese culture and visiting restaurants in Taipei, Tainan and Taichung. The trio embarks on the ultimate Taiwanese food adventure, trying delicious foods at their famous three different price points: affordable, middle tier, and luxury. At the end of the episode, the group decides which item is the most “worth it” at its given price. BuzzFeed’s “Worth It” has received 1.2 billion lifetime video views to date.

Taiwan Tourism Bureau’s expert itinerary coordinators organized travel, transportation and hotel accommodations for the “Worth It” cast and crew for ten days, and conducted outreach to several establishments featured throughout the special. The Bureau’s long-running connections with local businesses and operations provided “Worth It” with exclusive access and permissions to locations across the country.

The Taiwan Tourism Bureau is devoted to promoting Taiwan tourism to the world while pursuing the goals of globalization, digitalization, localization and sustainability. In November of 1999, the Chicago office was relocated to Los Angeles where the population and household average income were higher to strategically penetrate to and develop the Southern California tourism market. After two decades of effort, the number of American travelers to Taiwan has seen an 82.53% increase, from 317,801 in 1999 to 580,072 in 2018. With the implementation of “Project Vanguard for Excellence in Tourism” and the “Tourism 2020 Sustainable Tourism Development Strategy”, the number of US visitors to Taiwan has shown a rapid growth of 40.99% from 2012 to 2018.

2019 marks the “Year of Taiwan Small Town Ramble” and the “U.S.-Taiwan Travel Year” which celebrates 40 years of friendship and partnership between the United States and Taiwan since the signing of the Taiwan Relations Act. “Human rights protection is the core value of Taiwan’s freedom and democracy. The passing of same sex marriage this year further highlights Taiwan’s respect for basic human rights. This brings Taiwan in alignment with the core values of California, the world’s fifth largest economy with a population of nearly 40 million,” says Abraham Chu, Director General of the Taipei Economic and Cultural Office in Los Angeles.

“The State of California has the most flights to Asia, with a total of 66 weekly direct flights to Taiwan operated by Taiwan’s China Airlines and EVA Air, flying out directly from Los Angeles (31), San Francisco (28), and Ontario (7) respectively. We continuously work on ‘deepening existing markets and diversifying the sources of visitors’. In the next 6 months, we will collaborate with travel agencies and airlines to provide limited-time offers targeting younger baby boomers, Gen X, millennials, and Gen Z. This segment marketing strategy is going to take Taiwan tourism to new heights,” says Brad Shih, Director of Taiwan Tourism Bureau’s Los Angeles office.
