Ms. Mikulka obtained her bachelor’s degree from Rutgers University with Honors and graduated from Seton Hall School of Law in 1999. Dina was Law Clerk to the late Hon. George W. Parsons, Jr., J.S.C. (99-00) in the Bergen County Family Division. In addition to her strong litigation experience, Ms. Mikulka is a trained mediator, trained collaborative divorce practitioner and ESP Panelist. She has been court appointed as a Guardian Ad Litem on multiple occasions.

Ms. Mikulka is certified by the Supreme Court of New Jersey as a Matrimonial Law Attorney. Alexa also works part-time as a camp counselor at Central Florida Athletics. She does this to help her mother shoulder the cost of putting two of her children through college at the same time. Despite her very busy schedule, Alexa still finds time to contribute to the local community. She utilizes her musical theater background to coordinate performances with children from a local special needs school. In addition, she enjoys caroling at local nursing homes. Her commitment to volunteer work was recognized with the Community Service Award, given only to those who perform over 1,000 hours of community service a year.

Having suffered turmoil and loss at a very young age, Alexa found the resilience to not only cope but thrive in the years that followed. Excelling academically and becoming an active member of her community were the keys. As she noted, “Only through a loss so grievous could I realize the full extent of my fortitude—the aspect of my personality for which I remain the most grateful.”

Today, Alexa is a freshman at her late father’s alma mater, the University of Florida, where she is majoring in Biology. Eventually, she plans to go to medical school and become a doctor. The oldest of seven children, she was often thrust into the role of caretaker for her younger siblings due to family issues at home. Eventually, she and her siblings found themselves in and out of the foster care system.

However, Madelyn refused to be defined by her circumstances. We were struck by her determination to not just survive but thrive and forge a better future for herself and her family.

Madelyn epitomizes what the Legal Scholar Award is all about. By encouraging the next generation of attorneys, our hope is that they, in turn, will also value the importance of giving back.

Boasting an impressive academic record, Madelyn recently received her undergraduate degree from UCLA where she made the Dean’s Honors List on multiple occasions. While at UCLA, she also actively participated in several debate competitions with exceptional results. Among the most notable was as a member of the winning UCLA debate team in the Corsairs British Parliamentary Debate Invitational.

Outside of school, Madelyn’s employment history is already quite impressive. She has worked as an editorial intern at Larry King Now and as a publicity intern at Amazon Studios, among others. She also manages to carve time out of her busy schedule to teach public speaking to middle and high school students through the Forensics Club at UCLA, which she founded. And she volunteers at Bet Tzedek Legal Services, a Koreatown clinic that offers free legal services to low income members in the community.

Attorney David A. Fernandez Leads the Charge Against Giant Third-Party Student Loan Creditors

Unfortunately, and unknown to the investors was that the mortgages sold did not have a paper trail and, consequently, when the third party sued the debtor for failure to pay on the note, the third-party creditor couldn’t prove they owned the account.

Fernandez, who has been named to the Top 100 Consumer Litigators in Texas, has handled 104 student loan cases, the majority of which went in favor of his clients over creditors, including National Collegiate Student Loan Trust, Navient, and Sallie Mae. “The result of 102 out of 104 cases defended is that my clients have not had to pay a penny to these industry giants, particularly National Collegiate Student Loan Trust, one of the nation’s largest holders of private student-loan debt,” said Fernandez.

As for National Collegiate Student Loan Trust, in 2017 the Consumer Financial Protection Bureau took action against the company and its debt collector, Transworld Systems, Inc., for illegal student loan debt collection lawsuits. It was fined millions of dollars for “false” lawsuits, and ordered to temporarily halt collections.

These cases stem from private student loans that were sold by the original creditor, e.g. banks such as JP Morgan and Bank One, to third parties, including National Collegiate Student Loan Trust, Sallie Mae and Navient. Fernandez likens these student loan cases to the mortgage loan crisis in 2009 that caused extreme financial distress and a financial market crash. The reason for the crash was that the mortgages were bundled and securitized and sold to investors.

“Unfortunately, and unknown to the investors was that the mortgages sold did not have a paper trail and, consequently, when the third party sued the debtor for failure to pay on the note, the third-party creditor couldn’t prove they owned the account,” noted Fernandez. “It is the same here. When National Collegiate and the other third-party student loan creditors sue, they provide the defendant debtor with a number of documents that look official and seem to suggest the plaintiff owns the account, but after careful review of the documents, invariably there are problems regarding ownership of the account.”

When Fernandez and his firm take on one of these National Collegiate Student Loan Trust and other third-party student loan creditor cases they meticulously examine the student loan documents to determine whether the creditor can prove ownership of the account. “Although reviewing the records page by page is onerous, we do it and as you can see, we have had much success,” concluded Fernandez.

Saving the Second Amendment for Those Accused of Domestic Violence


I applaud the Nevada Supreme Court for unanimously doing the right thing

Since 1861 when Nevada became a state, no one accused of misdemeanor battery constituting domestic battery ever had a Sixth Amendment right to a jury trial because the offense was “petty” – meaning the maximum term of jail was 6 months. Under the law, Nevadans didn’t have the right to a jury trial because this offense was deemed “petty”.

How could these be a “petty” offense when Nevadans lose their Second Amendment right for life based solely on the decision of one judge and not a jury of his or her peers?

On September 12, 2019, Michael D. Pariente, Esq. changed that by convincing a unanimous Nevada Supreme Court that this was wrong – that every person in Nevada charged with misdemeanor battery constituting domestic violence must now be given a jury trial.
