Samuel Moultrie Appointed to Delaware Advisory Committee to the U.S. Commission on Civil Rights


Samuel L. Moultrie, an associate in the Delaware office of global law firm Greenberg Traurig, LLP, has been appointed to the Delaware Advisory Committee to the U.S. Commission on Civil Rights.

The U.S. Commission on Civil Rights, established by the Civil Rights Act of 1957, is an independent, bipartisan agency charged with advising the President and Congress on civil rights issues. It is the only federal department, agency or commission with a network of 51 statutorily-mandated federal advisory committees, in each state and the District of Columbia, that study civil rights issues in their states and report the results of their reviews to the Commission. In his role, Moultrie, along with other members of the Advisory Committee, will serve as the Commission’s “eyes and ears” on the ground and advise the Commission about civil rights matters in Delaware.

Stephen Newland, a partner, explained, “Many clients want to make sure they have a proper estate plan right now, but they are understandably concerned about needing to go to a lawyer’s office to complete this process, and they do not want anyone outside of their family to come into their homes. ”

Due to the health concerns that are affecting everyone in the United States, it is more important than ever for people to have a proper estate plan in place. This may include a will, living trust, power of attorney for property, and power of attorney for health care.

Curbside signings may sound like picking up items from a fast-food restaurant, but the services provided by Newland & Newland, LLP are very different. Since setting up a proper estate plan is one of the most important things a person can do, the firm has created a procedure for working with clients remotely. Through virtual meetings with clients, the firm’s attorneys can ensure that the proper estate plan documents are drafted, and these documents can then be executed through curbside signing.

During this process, a series of meetings thru Zoom, Skype, or FaceTime are set up to discuss the client’s needs and concerns. Once drafted, all documents are carefully discussed in detail using screen and document sharing to ensure the client’s needs are addressed satisfactorily.

Once the documents are fully explained to the client, and it is confirmed that all required information has been included, a curbside signing appointment will be set up. The client will park his or her car in a remote area of the parking lot of one of the Newland & Newland, LLP offices. Two members of the firm, who will wear masks and gloves, shall then witness and notarize the execution of the documents while the client remains in his or her car.

Court Closures May Slow Pre-Employment Background Screening Process; Opines CriminalBackgroundRecords.com

Criminal History Records and other important court related documents are often required in a pre-employment background check, but delays in access may prove challenging to employers.

The current COVID19 lockdown of non-essential workers has greatly impacted access for current county court records which could significantly impact pre-employment background screening. The lawsuit filed against Carter’s Retail, Inc., alleges the company failed to accurately pay PLAINTIFF for all the time they were under DEFENDANT’s control. Allegedly, Carter’s Retail, Inc., unlawfully and unilaterally failed to accurately calculate wages for overtime worked by their employees in order to avoid paying them the correct overtime compensation. State law provides that employees must be paid overtime at one-and-one-half times their “regular rate of pay.”

Additionally, the lawsuit alleges DEFENDANT required PLAINTIFF to work while clocked out during what was supposed to be PLAINTIFF’s off-duty meal break. Further, DEFENDANT failed to provide PLAINTIFF and CALIFORNIA CLASS Members with a second off-duty meal period from time to time in which these employees were required by DEFENDANT to work ten (10) hours of work. According to the Industrial Welfare Commission (IWC) Wage Order, DEFENDANT is required to pay PLAINTIFF and other CALIFORNIA CLASS Members for all time worked.
