Adult Murder Charges Dismissed and Life in Prison Avoided

The Rosenfeld Law Firm announced today that Case # CR-2021-2293, involving a client potentially facing adult murder charges, has been remanded to juvenile court. According to the San Joaquin County Superior Court, Mr. Folkes was originally charged with murder and potentially faced life in prison. California criminal defense attorney Ken Rosenfeld argued that Mr. Folkes’s young age should preclude him from facing adult murder charges. Despite objections made by the prosecution regarding the seriousness of the offense, the Court agreed with Rosenfeld that the case be adjudicated by juvenile court. Should Mr. Folkes be found guilty of murder by the juvenile court, he will face a disposition of being committed to a juvenile facility until the age of 25.

Rosenfeld said that the decision by the court to remand the case to juvenile court came as a profound relief for Mr. Folkes.

“Had the case remained in superior court, we’re seeing a young man looking at spending the rest of his life in prison,” said Rosenfeld. “We’re very pleased his case will be tried in an appropriate court for his age.”

New Survey Shows Widespread Intercompany Issues Impacting Corporations’ Business, Finance and Accounting Operations and Only Getting Worse

“These survey results confirm what FourQ has long known to be true about the state of intercompany. Difficult to manage, intercompany has become a huge drain on many multinationals’ valuable resources,” explained Jeremy Womer, CPA, Chief Customer Success Officer at FourQ.

FourQ, the leading provider of intercompany financial management software to streamline the global operations of the world’s largest companies, announced the results of a survey it conducted in conjunction with Dimensional Research. The research, titled “The Reality of Intercompany,” uncovered widespread issues related to corporations’ intercompany processes and procedures that negatively impact business outcomes and the operations of their finance, accounting, and tax teams.

A startling 96% of respondents report challenges with intercompany, with near total agreement (99%) that critical accounting responsibilities are becoming more complex and challenging. Finance and accounting professionals at multinational corporations with intercompany responsibilities believe that intercompany is a largely misunderstood concept (86%) that has significant negative impact to business operations and, disturbingly, takes a toll on employees’ daily lives. An astounding 90% reported their finance and accounting staff pull all-nighters at least once a year due to intercompany issues.

“Intercompany is a complex and difficult function that frequently flies under the radar,” said Diane Hagglund, Founder and Principal of Dimensional Research and author of the study. “Three quarters of respondents reported that intercompany volume at their corporation was two to 10 times that of their revenue, while an additional 18% cited intercompany volume that was more than 10 times revenue. Intercompany is causing significant and myriad issues across multinational corporations.”

Key findings in the report include:


  • Intercompany is a mess and only getting worse: Almost all (97%) of respondents say challenges within intercompany have a negative impact on business outcomes. Nearly half of respondents report that overdue intercompany balances create business uncertainty (49%), increase risk of SEC investigations (43%) and cause missed tax deduction opportunities (43%). Nearly half (48%) report unreconciled balances that are more than five years old.
  • Intercompany issues negatively impact the accounting, finance and tax operations while stressing the teams: Nearly all respondents (97%) say challenges with intercompany have a negative impact on finance and accounting operations. Concerningly, 98% say intercompany issues negatively impact their employees. Specifically, 60% of respondents report that their company’s intercompany processes increase stress among team members causing physical or mental health issues. Well over half (57%) report that employee churn makes it harder for the remaining team to resolve intercompany issues.
  • ERPs only partially solve intercompany issues; Improved technology holds promise: 96% of respondents agree that ERP systems only partially solve intercompany challenges. An almost equal amount (97%) say they would benefit from better technology capabilities for intercompany, with automated intelligent intercompany analytics and reporting topping the list (68%). Other capabilities that would improve intercompany operations include end-to-end transactional transparency for all intercompany stakeholders (56%); centralized dispute management (55%); automated cost and tax allocation (55%); automation of manual intercompany processes (50%); and allocated vendor invoice management (47%).

“These survey results confirm what FourQ has long known to be true about the state of intercompany. Difficult to manage, intercompany has become a huge drain on many multinationals’ valuable resources,” explained Jeremy Womer, CPA, Chief Customer Success Officer at FourQ. “Even with extensive and costly modifications, ERPs rarely can manage the complicated intercompany processes of large corporations. As a result, more and more companies are turning to the technology and discipline manifested in intercompany financial management.”

Survey Methodology

The survey was conducted by Dimensional Research, on behalf of FourQ, between November 17 and December 2, 2021. A total of 106 finance and accounting professionals participated in the online survey, all of whom worked at multinational companies and were knowledgeable about their companies’ intercompany. Respondents worked at companies in a variety of industries with 74% having more than 100 legal entities. The purpose of the survey was to understand the intercompany experiences of finance and accounting stakeholders.

Mental Health Attorney Ken Rosenfeld Secures Repeated Wins for his Clients

Keeping my client in the state hospital was preventing the forward movement of his progress.

The Rosenfeld Law Firm today announces that a mental health client who had been prevented by false medical information from being transferred into a conditional release program (CONREP) from the state hospital, where he’d been committed, was successfully granted conditional release after the intervention of California Mental Health Attorney Ken Rosenfeld.

According to court documents from the Sonoma County Superior Court (Case # SCR-679678-1), River H. had been committed to a California state hospital in 2016 following a plea of Not Guilty by Reason of Insanity. In spite of recommendations from hospital staff who worked closely with him that he demonstrated the psychiatric stability to qualify for CONREP, the state hospital medical director (repeatedly) denied CONREP for River H., citing specific detriments in his records as disqualifying him from CONREP eligibility. On behalf of his client, Rosenfeld illustrated to the hospital director the falsehood of the detriments in River H’s hospital records. When the hospital persisted in its refusal to recommend CONREP, Rosenfeld presented his argument in Sonoma County Superior Court, after which time the judge approved conditional release for River H.

Rosenfeld said the victory came as a great relief for his client, who, by virtue of CONREP, will be able to reintegrate into the community.

St. Louis Metropolitan Police Department Now Using STRmix


The Metropolitan Police Department, City of St. Louis is the 69th organization in the U.S. to approve the use of STRmix™, sophisticated forensic software capable of resolving mixed DNA profiles that previously were regarded as too complex or degraded to interpret.

With nearly 2,000 employees, the Department is the primary law enforcement agency for the city of St. Louis, MO. It plans to use STRmix™ in its scientific testing of crime scene evidence.    

Since its introduction nearly a decade ago, STRmix™ has established a highly successful track record of producing usable, interpretable, and legally admissible DNA evidence in a wide range of criminal cases. It has proven to be particularly effective in resolving violent crime and sexual assault cases, as well as cold cases in which evidence originally dismissed as inconclusive was able to be reexamined.

“To date, STRmix™ has been used to interpret DNA evidence in more than 300,000 cases worldwide,” says John Buckleton DSc, FRSNZ, Forensic Scientist at the New Zealand Institute of Environmental Science and Research (ESR) and one of the developers of STRmix™.

According to Buckleton, STRmix™ relies on proven methodologies routinely used in computational biology, physics, engineering, and weather prediction to assess how closely multitudes of proposed profiles resemble or can explain an observed DNA mixture.

“The probability of the observed DNA evidence can be calculated by assuming the DNA originated from either a person of interest or an unknown donor,” Dr. Buckleton explains. “These two probabilities can then be presented as a likelihood ratio (LR), inferring the value of the findings and level of support for one proposition over the other.”

In addition to the Metropolitan Police Department, City of St. Louis, STRmix™ is currently being used in the U.S. by such well-known agencies as the FBI and the Federal Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF). In addition, nine state and territory forensic laboratories in Australia and New Zealand, and 14 labs in other countries including the U.K., Ireland, Canada, Finland, Switzerland, and Denmark are now using STRmix™.

A new version of STRmix™, Version 2.9, was recently launched. STRmix™ v2.9 contains a number of new features, including: the introduction of a batch maker mode, allowing multiple interpretations to occur simultaneously and database search templates; memory usage improvements, which are particularly significant in dealing with higher order DNA profile mixtures; and improvements to biological modelling calculations designed to improve the modelling of stutter peaks.

The Rosenfeld Law Firm announced today that attempted murder charges filed against its client in Case #CR-2020-9424 in San Joaquin County Superior Court were dismissed as a result of California criminal defense attorney Ken Rosenfeld’s negotiated plea agreement.

According to court documents, the case allegedly involved Mr. Perez stabbing a man multiple times in the neck and face with a knife. Charged with attempted murder with a knife and several other offenses, Mr. Perez faced the possibility of a sentence of 50 years to life in prison. In the plea agreement negotiated by Rosenfeld, Mr. Perez pled to assault with weapon, which led to the dismissal of the attempted murder with premeditation charges. Ultimately, the negotiation resulted in a 9-year total sentence for Mr. Perez.

“We’re pleased at the outcome, and my client was extremely grateful,” said Rosenfeld. “He said to me, ‘I was looking at spending the rest of my life in prison and you stopped that from happening. Thank you for saving my life.’”

Criminal Defense Attorney Noah Kilroy Helps Drug Mule Arrested With 15 Kilograms of Fentanyl Get 3 1/2 Year Sentence

“A life sentence was on the table at one point. We convinced the judge to give him a three and a half year sentence.”

Nelson A. Garcia Martinez, 40, pleaded guilty to transporting approximately $14 million worth of fentanyl across the country to Sturbridge, Massachusetts, for a payment of $6,000. At the time he agreed to participate, he had no knowledge of the specific drug being transported or its value. Garcia Martinez was employed as a truck driver operating out of California where he and his wife and children reside. He had no prior criminal history.

“If I could go back in time I would have never done it,” stated Garcia Martinez, through a Spanish interpreter, “I ask for forgiveness from the state of Massachusetts . . . and the United States.” Garcia Martinez is a native of El Salvador who has been working to build a life for his family in the United States, although he has illegal immigrant status.

The father of five was arrested in November of 2018 after delivering 15 kilograms of fentanyl connected to a large drug bust a month prior. Authorities obtained a warrant to track Garcia Martinez’s phone and monitor his cross-country trip. He was charged with the distribution of 400 grams or more of fentanyl.

Garcia Martinez has been imprisoned since his 2018 arrest and has not seen his family since embarking on the trip from California to Massachusetts. The financial burden of cross-country visitation, coupled with losing their income from Garcia Martinez’s trucking job, has prevented them from traveling to see him.

Noah J. Kilroy represented Garcia Martinez as his attorney in this drug trafficking case. Unlike many legal professionals, Kilroy has an in-depth understanding of the criminal justice system, having served time himself for drug trafficking. The experience of being incarcerated was life-changing for Kilroy, who now finds himself on the other side of the law, representing those who deserve a second chance, like the one he received.

Kilroy was abandoned at birth by a drug-addicted mother and shuffled through the foster care system. He eventually dropped out of high school and found a way to make ends meet the only way he knew how. He was arrested multiple times for selling drugs but not deterred. It wasn’t until his last incarceration, in which he was arrested with over 2 kilograms of cocaine, that he chose to pursue a different path in life. He graduated from law school in 2013.

Nelson Garcia Martinez was also facing serious charges that could forever change his ability to be a present father and serve society in a meaningful way, after only one criminal offense.

“They’re (considered) expendable,” Kilroy said of drug mules. The attorney also noted that Garcia Martinez was not even told where specifically he was driving his tractor-trailer until he got to Massachusetts. He did not know the sellers or buyers of the product he was transporting.

Kilroy asked Judge Timothy S. Hillman for a 36-month sentence. Assistant U.S. Attorney Nadine Pellegrini requested 46 months due to the large number of drugs involved in the case. Judge Hillman split the requests and issued a sentence of 42 months in prison. Without zealous legal advocacy, Garcia Martinez could have faced much more significant penalties.

The 42-month sentence will also include time served while in holding prior to the trial. Upon Kilroy’s request, Judge Hillman agreed to recommend that Garcia Martinez be transferred to a federal prison close to his family in California.
