Mother of 7-year-old Child Alleged to have been Killed by FedEx Driver to Speak During Press Conference

A press conference will be held at 11 a.m. on Thursday outside the Wise County Courthouse, where the mother of 7-year-old child will give a statement about the tragic death of her daughter.

Maitlyn Gandy will address the media alongside her attorney, Benson Varghese. In addition to Gandy’s statement, Varghese will answer questions, as well as provide information on how the community can continue to support the family during their extraordinary journey through grief.

Maitlyn Gandy retained Varghese Summersett Injury Law Group on Monday to assist in the investigation, which has garnered extensive media attention and has the public demanding justice, both criminally and civilly.

The child was found dead last week after a FedEx driver allegedly kidnapped and killed her after making a Christmas delivery to her father’s home in Paradise. He has been arrested on charges of capital murder and kidnapping and is being held in Wise County on a 1.5 million dollar bond.

Leitner Varughese Warywoda Argues Bellweather Case before the US Court of Appeals, Second Circuit to Determine Fate of Thousands of Nursing Home Death Lawsuits


We eagerly await the Court’s Decision so that discovery may commence in these tragic circumstances”, stated Brett R. Leitner, counsel for Rivera-Zayas.

Leitner Varughese Warywoda represents Vivian Rivera-Zayas, the daughter and administrator of the estate of Ana Martinez, who was admitted to Our Lady of Consolation Nursing & Rehabilitation Care Center in West Islip, New York for a short-term stay for physical therapy with the plan to return home after a few weeks. It is alleged that she never left the facility and reportedly died of COVID because of Our Lady of Consolation’s failure to implement proper infection control measures in violation of federal and state rules, specifically the “abject and longstanding failure to maintain a system for preventing, identifying, reporting, investigating and controlling infections and communicable diseases,” according to the complaint, which is attached. The case is Rivera-Zayas v. Our Lady of Consolation Geriatric Care Center et al., case number 2:20-cv-05153, in the U.S. District Court for the Eastern District of New York.

Our Lady of Consolation, along with two lobbying groups for New York hospitals and nursing home owners, the Greater New York Hospital Association and the Healthcare Association of New York State, previously filed briefs in the Eastern District of New York seeking to dismiss the suit, claiming the Public Readiness and Emergency Preparedness Act (PREP Act) bars lawsuits against nursing homes during a public health emergency. The Hon. Nicholas G. Garaufis, United States District Judge, sided with Leitner Varughese Warywoda, and denied the nursing home’s motion to dismiss the lawsuit, allowing it to proceed in New York State Supreme Court (decision attached).

Defendant Our Lady of Consolation appealed to the United States Court of Appeals for the Second Circuit, assisted by a congregation of powerful New York State and national lobbying groups also submitting briefs in favor of the nursing home, including Greater New York Hospital Association (“GNYHA”), the Healthcare Association of New York State, Inc. (“HANYS”), Atlantic Legal Foundation, DRI (Defense Research Institute), The Chamber of Commerce of The United States of America, the American Medical Association, and the Medical Society of the State of New York. The Court of Appeals docket is attached.

”The simple truth here is that Ms. Rivera-Zayas does not allege that her mother died because of “the administration or use of a covered countermeasure” by anyone, but rather because of Our Lady of Consolation’s broad failures to adopt effective infection-control policies—policies that are not “covered countermeasures. We eagerly await the Court’s Decision so that discovery may commence in these tragic circumstances”, stated Brett R. Leitner, counsel for Rivera-Zayas.

California Criminal Defense Attorney Ken Rosenfeld Ensures All Charges Dismissed for Man Accused of Rape

The Rosenfeld Law Firm announced today that a man facing charges of rape and violation of a restraining order has had all the charges against him dismissed as a result of the efforts of California criminal defense attorney Ken Rosenfeld.

According to the Superior Court of California, County of Placer (Case #62-176083), Rutan had initially been accused of raping and impregnating an immigrant woman from Albania he had met online. A permanent restraining order (PRO) was consequently placed against Rutan who was accused of violating his PRO by appearing at the woman’s home and was placed in jail. Although advised by his then-attorney to plea to sexual battery and receive its lower penalties (as per California Penal Code §243.4(a)), Rutan, acting on a second opinion received from Rosenberg just prior to his appearance in court, refused to plea. Rutan retained Rosenfeld as his defense attorney. Rosenfeld, supported by the discoveries of a private investigator, successfully showed not only that the woman in question had been seeking a green card and claimed she was raped only after Rutan refused to marry her, but also that the restraining order violation was the result of a setup orchestrated by the woman. As a result, all charges against Rutan were dismissed.

Rosenfeld said his client was relieved to put the matter behind him.

“This is a tremendous relief for Mr. Rutan,” said Rosenfeld. “Instead of years behind bars, he is free. He gets to see his child.”

The Rosenfeld Law Firm announces that Case # CR-2015-4102672, a third-strike case involving a client charged with multiple felonies, has been dismissed, thanks to the efforts of California criminal defense attorney Ken Rosenfeld.

According to the May 4, 2022, court documents filed with the San Joaquin County Superior Court, Dwayne Sterling Lawson was taken into custody in Nevada in December of 2017 and was committed to serve a prison sentence of 24 to 114 months; however, a Stockton Police Department detainer was filed with the Nevada Department of Corrections requesting extradition. As per the complaint filed with the San Joaquin County Superior Court, Lawson was accused by the San Joaquin district attorney of the felonies of human trafficking, kidnapping, pimping, criminal threats, and felon/addict possession of a firearm. The complaint also refers to prior serious felony convictions of voluntary manslaughter and burglary in the first degree for Lawson, both of which, if convicted, qualified Lawson for a third-strike sentence (25 years to life) according to California’s Three Strikes sentencing law.

Rosenfeld argued that, despite his client’s compliance in filing the appropriate written notice of his imprisonment in a Nevada state prison and his request to the Stockton court for a disposition of charges according to the Interstate Agreement on Detainers, the prosecuting attorneys in California failed to bring Lawson to trial within 180 days. Rosenfeld therefore made the motion, pursuant to Penal Code 1389, to dismiss all charges against his client. The motion was granted.

“I am very proud of the work done here,” said Rosenfeld. “Our client was looking at life in prison in three different ways, but all the charges against him have been dismissed.” Mr. Lawson made a point to say, ‘I had a lot of attorneys but only Kenneth Rosenfeld got in and fought for me. Kenneth battled every legal issue and won every fight. I was facing life in prison and without Kenneth Rosenfeld I would be in prison forever. He is the best there is in this business.’”

Dallas Entrepreneur Justin Magnuson Launches Justice Reform Foundation to Support Victims of the Criminal Justice System and Advocate for Change

Local entrepreneur and Dallasite Justin Magnuson today announced the launch of the Justice Reform Foundation (JRF), a nonprofit organization dedicated to helping those impacted by America’s broken criminal justice system.

Magnuson experienced the fundamental dysfunctions in the U.S. criminal justice system firsthand when he found himself wrongfully accused and unlawfully incarcerated. Magnuson ultimately spent 20 months in a county jail under false pretenses during the height of the Coronavirus pandemic.

Magnuson is a self-made entrepreneur who worked his way through undergrad at University of North Texas and grad school at Southern Methodist University. As he was pursuing his Executive MBA from UCLA and commuting between Dallas and Los Angeles, he decided to expand his business ventures into the legal cannabis industry. He partnered with producers in California already legally growing cannabis and obtained all necessary permits for the business but, unbeknownst to him, the people he’d partnered with had violated federal law by selling products across state lines.

The prosecution had no evidence to produce a guilty verdict and still, due to the abuse of bail systems, he was detained and had his life upended. However, despite the difficulty he faced, Magnuson recognizes it was still a privilege he was able to walk away at all.

The experience compelled Magnuson to do his part to help fix a broken system by launching the Justice Reform Foundation, a non-profit advocating for structural change in the criminal justice system that is destroying lives and hurting families across the nation. Magnuson wants to ensure that people with fewer resources than him have the opportunity to get their lives back on track.

“I’m honored to have the ability to use my platform to aid those most directly impacted by the criminal justice system,” said Justin Magnuson, founder, and president of the Justice Reform Foundation. “Our system has long discriminated against the very citizens it is meant to protect. The Justice Reform Foundation is going to fight against the disparities that start with a person’s first contact with the system and continue through court hearings, conviction, incarceration, release, and thereafter.”

Magnuson wants to bring awareness to the same unjust practices he was victim to, so the JRF will educate the public on topics like unlawful detainment, the need for bail reform, the importance of decriminalizing marijuana, prosecutorial misconduct, the abuse in the use of confidential informants, and the disparate treatment among classes of citizens.

The Justice Reform Foundation recognizes the importance of listening to and working with individuals already well-versed in criminal justice activism. In the coming weeks and months, the Foundation will focus on expanding our board of directors, vetting volunteers to support our reintegration program, and seeking partnerships with other organizations focused on criminal justice reform.

The Northern California labor law attorneys, at Zakay Law Group, APLC and JCL Law Firm, APC, filed a representative action complaint against The Lagunitas Brewing Company (“Lagunitas Brewing Company”), for allegedly failing to accurately pay employees’ wages for all their time worked. The Lagunitas Brewing Company class action lawsuit, Case No. SCV-271412, is currently pending in the Sonoma County Superior Court of the State of California. According to the lawsuit, Lagunitas Brewing Company allegedly violated California Labor Code Sections §§ 201, 202, 203, 204, 221, 226, 226.7, 246, 351, 510, 512, 558, 1194, 1197, 1197.1, 1198, and 2802 by failing to: (1) pay minimum wages; (2) pay overtime wages; (3) provide required meal and rest periods; (4) reimburse employees for required expenses; (5) provide wages when due; (6) provide accurate itemized wage statements; (7) provide gratuities; and (8) unlawful deductions.

California Labor Code Section 226 requires an employer to furnish its employees an accurate itemized wage statement in writing showing (1) gross wages earned, (2) total hours worked, (3) the number of piece-rate units earned and any applicable piece-rate, (4) all deductions, (5) net wages earned, (6) the inclusive dates of the period for which the employee is paid, (7) the name of the employee and only the last four digits of the employee’s social security number or an employee identification number other than a social security number, (8) the name and address of the legal entity that is the employer and, (9) all applicable hourly rates in effect during the pay period and the corresponding number of hours worked at each hourly rate by the employee. Lagunitas Brewing Company allegedly failed to provide its employees with accurate itemized wage statements that complied with all the requirements of California Labor Code Section 226.

Neil, Dymott, Frank, McCabe & Hudson APLC is excited to welcome Jesse Adriance to the firm! Jesse started Adriance Law 10 years ago primarily handling criminal defense cases, specializing in DUIs. While working on a case on opposing sides, Michael Neil approached Jesse at the end of the case and was impressed with how he handled the matter. He asked Jesse if he had any interest in practicing civil defense and expanding his legal expertise in other fields. Jesse explained, “Mr. Neil is extremely persuasive, probably due to his many years as a general in the U.S. Marine Corp, which I was not aware of at the time. He really got me thinking and I decided to take the leap!”

Jesse knew it was a commitment and a huge change after running his own practice for so many years, but he made the decision on July 15th to close Adriance Law and start a new chapter. Robert (Bob) W. Frank, a named partner and shareholder at Neil Dymott, is very happy now for an attorney to join his team to assist him with the wide array of cases that he tackles. Talent is not easy to find especially since the pandemic, and Mike Neil’s feedback about Jesse’s demeanor as well as his professionalism led Mr. Frank to interviewing Jesse as a potential candidate.

On Tuesday, August 2nd, Mr. Adriance became the 10th associate attorney with Neil Dymott. The Firm looks forward to having Jessie’s 10 years of experience added to the firm’s team approach to representing clients into the future.
