HILIFE MUSIC GROUP Successful in seven-year Name and Trademark dispute


Hilife Music Group putting into effect their earlier unregistered rights, argued that the use of the name Hilife, by Hilife Music Entertainment was a misrepresentation of the brand name that could damage the reputation of the already established Hilife brand in goods and services of music and entertainment in which they claimed to have several years of goodwill prior to Hilife Music Entertainment trademarks.

The Hilife Music Group legal team, additionally making the argument that the fundamental and defining factor of the Hilife Music Group name is “Hilife”, and that the additional elements of the company name merely stated that they are a group of companies in addition to the goods and services that they provide, and that applying this principle to the company name Hilife Music Entertainment further highlighted the fact that both company names are highly similar and therefore use of the name “Hilife” by Hilife Music Entertainment is a misrepresentation of the name “Hilife” which would cause damage to the already established brand as well as confusion in the market place by means of presumed association or connection to Hilife Music Group, where there is none.

During earlier proceedings that were issued against Hilife Music Entertainment at The Company Names Tribunal, Hilife Music Group were unsuccessful in their legal effort for a compulsory change of name of Hilife Music Entertainment however, were aided by the legal ruling of this dispute which confirmed that Hilife Music Group had goodwill in the name “Hilife” prior to Hilife Music Entertainment’s first use.

In the following trademark tribunal proceedings that took place, at the European Union Intellectual Property Office and through the UK Intellectual Property Office. Hilife Music Entertainment argued that they owned the trademarks for Hilife and Hilife Music whereas Hilife Music Group argued that they had earlier unregistered rights that they stated date back as far as 2007 when Hilife Music Group originally commenced operations, adding that the name Hilife Music was used from this time and was only later registered as a limited company in 2014, in addition to the name Hilife Music Group that was also used from 2007 but only later registered as a limited company in 2015, Hilife Music Group arguing nonetheless all taking place a number of years prior to Hilife Music Entertainment trade mark registrations.

The decision at the UK IPO adjudicated in December 2022 was granted in favour of Hilife Music Group, in accordance with UK IPO trade mark law. An appeal by Hilife Music Entertainment was recently decided at the UK IPO, and once again granted in favour of Hilife Music Group, with the original decision of December 2022 being upheld and Hilife Music Group being successful in removing Hilife Music Entertainment UK trademarks for goods and services of music and entertainment for the trademarks, Hilife, Hilife Music and Hilife Music Group.

A Hilife Music Group source said: “We have been using the name Hilife Music for many years now and have a longstanding reputation in music and entertainment, and for a third party to appear a number of years later and to register a highly similar mark for identical and highly similar goods and services, would inevitably cause confusion, In the initial stages of the seven-year dispute we asked Hilife Music Entertainment to change their name but they refused, making these proceedings necessary, the UK IPO having now seen the evidence, have ruled that Hilife Music Entertainment were in violation of our trademark rights. We are pleased that the UK IPO ruled in our favour.”

In an official statement released by the Hilife Music Group CEO, Adrian Fife said, “This is a momentous occasion for myself and our company and all that are involved, as the seven-year timespan would suggest it has been a long and complex process, we are delighted that it has come to a successful conclusion.

Affordable Housing Has Positive or No Impact on Property Values, Review From A-Mark Finds


SANTA MONICA, Calif., Aug. 25, 2023 /PRNewswire-PRWeb/ — The housing shortage is fueled, in part, by resistance to building low-income or affordable housing in wealthier neighborhoods. A-Mark Foundation gathered research on how affordable housing affects home prices — and the results are not what many people might expect. Research studies into the impact of low-income housing on neighborhood property values have generally concluded that there was either no impact or a positive impact on property values.

Even in studies where results were mixed, some positive impacts on property values were found. Of the 13 studies in A-Mark’s report, seven found that when low-income housing was built, property values in the neighborhoods increased.

Three studies in A-Mark’s report showed that building low-income properties has different impacts depending on the type of neighborhood. Two of those studies concluded that low-income housing had a negative impact on property values if built in affluent or higher-income areas, but a positive impact if built in areas with more lower-income residents or a lack of existing investment. Another study, however, had the opposite conclusion.

Rob Eshman, A-Mark Foundation CEO, wrote about the report’s findings in an article for the Los Angeles Times titled, “Stop worrying, NIMBYS — affordable housing shouldn’t squash your property values.

In his column, Eshman began with the observation that in his Venice, Calif., neighborhood, affordable housing did not impede the rise in home values. He interviewed California housing experts and developers, who spoke about challenges in getting wealthier neighborhoods to accept low-income housing even though their fears are likely unfounded.

“My family’s neighborhood may be an outlier,” Eshman wrote, “but at least for the last three decades, it has also served as vibrant proof that the notion that affordable housing lowers property values is overblown, if not flat-out wrong.”

A-Mark also created a 10-question affordable housing quiz that tests readers’ knowledge on low-income housing and property values to accompany the report.

NAIFA, FSP, and Life Happens Unite to Advance Financial Security for America


NAIFA and FSP have worked closely together over the last several years in a joint venture, the NAIFA-FSP Advanced Practice Center (APC). APC serves as a thought leadership hub for financial advisors, insurance agents, attorneys, CPAs, and other advisors who work collaboratively on advanced planning issues. “Global Boiling” Rejected by Many


Long-time climate policy analyst Roger Pielke, Jr. has written a detailed review on wildfires, published June 8, 2023, stating “The IPCC has not detected or attributed fire occurrence or area burned to human-caused climate change.”

The Covering Climate Now media collaboration is directing their signatory members – some 400 media outlets reaching an audience of 2 billion did an interview in the spring of 2020 with the director of Mad Max, to find out ‘how to make climate fear compelling.’

Climate scientist Mike Hulme’s new book “Climate Change isn’t Everything” discusses how ‘Climatism’ has become a master-narrative in society which is used to blame everything on. Being simplistic, all-encompassing, and ever more apocalyptic in language, it forms a compelling, emotional master-narrative that defies reasoned debate. Hulme holds a mainstream view of Anthropogenic Global Warming, but rejects climate emergency and climate deadline thinking as dangerous to society, leading to totalitarian reactions, as outlined in a co-authored commentary in [Nature July 22, 2019.

Climate scientist Judith Curry’s new book “Climate Uncertainty and Risk: Rethinking Our Response” also takes a more nuanced view of climate change and discusses how we can break the gridlock on the climate debate.

Curry is a strong supporter of CLINTEL’s review of the IPCC AR6 reports, titled “The Frozen Climate Views of the IPCC” which discusses the predictable thinking and many errors of the IPCC AR6 – the document governments use to set climate policy.

CLINTEL’s list of more than 1600 scientists and scholars reject the notion of a climate emergency and the cadre now includes Dr. John Clauser, winner of the 2022 Noble Prize in physics.

Premier Danielle Smith of Alberta has put a 6 month moratorium on wind and solar. The provincial grid faced seven near blackout events last fall, in all of them the collapse of renewables was a key factor, according to the AESO 2022 Market Statistics report. Smith also opposes Canada’s Clean Electricity Standard NetZero plan, saying it is impossible to achieve by the targeted dates and under the proposed restrictions on natural gas.

As a result of their rigorous work schedules, ConvergeOne’s employees were allegedly unable to take off duty rest breaks and were not fully relieved of duty for rest periods. Specifically, the lawsuit alleges employees were required from time-to-time to work in excess of four (4) hours without being provided ten (10) minute rest periods as a result of their overburdened work requirements and inadequate staffing. Further, the lawsuit alleges these employees were denied their first rest periods of at least ten (10) minutes for some shifts worked of at least two (2) to four (4) hours from time to time, a first and second rest period of at least ten (10) minutes for some shifts worked of between six (6) and eight (8) hours from time to time, and a first, second and third rest period of at least ten (10) minutes for some shifts worked of ten (10) hours or more from time to time. Additionally, ConvergeOne’s employees were also allegedly not provided with one-hour wages in lieu thereof. As a result of their allegedly rigorous work schedules and inadequate staffing, ConvergeOne’s employees were from time to time allegedly denied their proper rest periods by ConvergeOne.

East Palestine, Ohio Group Launches Effort To Provide Air Purifiers To Homes Throughout The Train Derailment Disaster Area


Months after the disaster, many residents of East Palestine are still experiencing symptoms including respiratory illness, nosebleeds, rashes, eye infections, and anxiety over potential long-term exposure to toxins. According to media reports, recent independent testing showed levels of dioxins in the soil to be between 27,000-164,000% higher than normal. In March, a team of 15 doctors and epidemiologists with the federal Agency for Toxic Substances and Disease Registry began surveying residents but had to withdraw on the first day after seven of its members developed suspicious symptoms, according to reports.

“People in East Palestine have a legitimate reason to be concerned about how the toxic chemicals they are being exposed to will affect them in the years to come,” said Rick Vickroy, regional director of Germ Solutions USA. “Consider what happened in lower Manhattan after September 11 – more people died of cancer from long term exposure to toxic chemicals than died in the attack. These air purifiers will go a long way towards giving residents peace of mind that the air and surfaces in their homes and businesses are as contaminant-free as possible.”

“This disaster has upended our community: residents are leaving, businesses are suffering, and parents with young children are anxious about their health,” said Bob Helbeck, pastor of The First Church of Christ East Palestine. “Providing a home or business with an air purifier will give peace of mind; everyone will feel much safer. We are hopeful that by providing more air purifiers, we will see fewer illnesses and more people will feel comfortable staying in our community.”

Since the disaster, the church has already distributed nearly 500 hundred Beyond Guardian Air Generation II (BGA Gen II) air purifiers to homes and small businesses in the affected area, including 160 units, donated by Germ Solutions USA, that were placed in every classroom and common area in the East Palestine elementary, junior high and high schools. The BGA Gen II employs the same technology as FDA Class 2 purification systems currently used in hospitals and reduces 99.9% of contaminants in the air and on surfaces.
