According to a September 5, 2019, press release by the United States Attorney’s Office for the Northern District of California, Dr. T. was among the 13 Bay Area doctors charged with violating Title 42, United States Code, Section 1320a-7b(b)(2)(A) by allegedly accepting kickbacks for providing patient referrals to both Amity Home Health Care and Advent Care, Inc., for home health and hospice services. Statute 42 U.S.C. § 1320a-7b(b)(2)(A) criminalizes intentionally soliciting, offering, or paying a kickback, bribe, or rebate for providing services under a federal health care program. Since it involved patients insured by Medicare, the kickback scheme violated this statute. Defense attorney Allen Sawyer negotiated a deferred prosecution agreement with the U.S. Attorney’s Office, which secured community service for Dr. T., after which the charges against him were dismissed. Sawyer furthermore interceded on his client’s behalf with the Medical Board of California, ensuring the dismissal of all administrative action against Dr. T.’s medical license.
