Any new Johnson & Johnson Depuy Pinnacle hip lawsuits can now be filed and tried in New Jersey, making the legal process faster and more efficient than in the past.

Attorneys at mctlaw win a legal victory for people across the country in the Pinnacle hip replacement litigation. A federal judge in the District Court of New Jersey ruled that 33 cases against Johnson & Johnson should move out of federal court and back into New Jersey state court where J&J is headquartered (Case No. 22-1320). This means people from around the country may be able to file Pinnacle hip replacement lawsuits in New Jersey for a faster and more efficient trial process.

Johnson & Johnson argued that they did not design or sell the alleged defective DePuy Pinnacle hip implants so it was wrong to file these lawsuits in the company’s home state of New Jersey. Johnson & Johnson acquired DePuy, Inc. in 1998. However, Judge Zahid N. Quraishi sided with attorneys Michele Stephan of mctlaw and Josh Kincannon from Wilentz, Goldman, and Spitzer PA who represent the 33 plaintiffs.

What does this victory mean for future Pinnacle hip lawsuits? Any new Johnson & Johnson Depuy Pinnacle hip lawsuits can now be filed and tried in New Jersey, making the legal process faster and more efficient than in the past. Before plaintiffs were stuck in a slow-moving process called Multi-District Litigation or MDL, which lasted almost a decade. The Federal multidistrict litigation (MDL) for Pinnacle hip lawsuits closed as of June 2022, and no new cases can be filed in it. New cases filed in the New Jersey state court will not be part of the MDL, which means injured people may see justice sooner.
