Attorney Alex Galindo with Curd, Galindo & Smith, LLP of Long Beach California has filed the lawsuit. The court records state that the Plaintiff, Ms. Hurley’s 11 year-old son, alleges, that On October 8, 2019, his mother, Ms. Hurley met with a general surgeon, James Murray, M.D. to discuss a hernia repair surgery and sign the necessary documents. The court records state Ms. Hurley was provided with an informed consent which indicated the associated risks with the subject surgery. The disclosure did not indicate that death was a known risk associated with the surgery. The surgery was described as a simple outpatient surgery. The outpatient surgery was scheduled for 07/01/2020. The lawsuit alleges that on July 1, 2020, Ms. Hurley presented to St. Mary’s Medical Center in Long Beach and was taken to an operating room wherein Dr. Murray and his assistant Dr Tatum where to perform the hernia repair.
Court records say that during the surgical procedure Dr. Murray and Dr. Tatum commenced with the entry of Ms. Hurley’s abdominal wall with a 12mm trocar. The lawsuit further alleges that upon entry the 12mm trocar lacerated Ms. Hurley’s aorta/inferior vena cava, and as a result she developed a large amount of bleeding. The court records further state that Ms. Hurley subsequently developed a cardiac arrest from hemorrhagic shock and CPR was commenced and continued for over two (2) hours until a pulse was regained and massive transfusion protocol was initiated and the aorta was attempted to be repaired. The lawsuit goes on to state that Ms. Hurley was then transferred to ICU and remained on mechanical ventilation and her abdomen was left open subject to infection. Ms. Hurley again went to the operating room on July 4, 2020 for repeat exploratory laparoscopy and closure of the abdominal wall which was performed by Dr. Murray. During that surgery, the lawsuit alleges that further complications developed including the right lung collapsing after a central venous catheter insertion was attempted subsequent to a chest tube placement. The court records allege that Ms. Hurley suffered a large intraparenchymal hemorrhages at her right frontal lobe and right parietal lobes measuring 1×2 and 5.3 x 2.5 cm.
The court documents allege that Ms. Hurley died as a result of complications of the aortic vascular injury during the intra-operative repair of the abdominal hernia. Ms. Hurley sustained sufficient blood loss to cause the hypovolemic shock and code blue. The court record also alleges that extensive resuscitative efforts were performed. This led to significant hypoxic/reperfusion damage to the liver and brain, ultimately causing her death.
The family has sued for unspecified damages and allege that the care and treatment provided by DIGNITY HEALTH dba ST MARY’S MEDICAL and Dr. Murray was below the standard of appropriate medical care leading to the death of Ms. Hurley on July 11, 2020.
Ms. Hurley leaves behind her 11 year old son, her mother and sister.
