The Sleep Data Services LLC, class action lawsuit, Case No. 37-2020-00032747-CU-OE-CTL, is currently pending in the San Diego Superior Court of the State of California. The complaint alleges Sleep Data Services LLC committed acts of unfair competition in violation of the California Unfair Competition Law, Cal. Bus. & Prof. Code §§ 17200, et seq. (the “UCL”), by engaging in a company-wide policy and procedure which failed to accurately calculate and record the correct overtime rate for the overtime worked by PLAINTIFF and other CALIFORNIA CLASS Members. As a result of DEFENDANT’s intentional disregard of the obligation to meet this burden, DEFENDANT allegedly failed to properly calculate and/or pay all required compensation for work performed by the members of the CALIFORNIA CLASS and violated the California Labor Code.
Additionally, “DEFENDANT subjected PLAINTIFF to adverse employment action by retaliating against PLAINTIFF.” Allegedly, DEFENDANT failed to properly maintain standard safety measures at the job site and placed employees in a constant risk during the COVID-19 pandemic. As an alleged retaliation, PLAINTIFF’s employment resulted in termination, which is protected against public policy.
