Mctlaw Files Wrongful Death Lawsuit on Behalf of Florida Woman who Suffered Kratom Overdose

Krystal died on Fathers Day 2021, just days after celebrating her oldest son’s high school graduation. Her fiancé found her collapsed face down on the floor of their kitchen in front of their infant son, when minutes earlier she was preparing breakfast for the family.

The family of a Palm Beach County woman has filed a wrongful death lawsuit (Case No. 9:22cv81731) against Sean Michael Harder, of Grow LLC (d/b/a KD Incorporated and The Kratom Distro). The lawsuit alleges that Mr. Harder’s kratom products are responsible for the death of 39-year-old mother of four, Krystal Talavera.

According to court documents, Krystal died on Father’s Day 2021, just days after celebrating her oldest son’s high school graduation. Her fiance found her collapsed face down on the floor of their kitchen in front of their infant son, when minutes earlier she was preparing breakfast for the family. The court documents allege that there was a cup of hot coffee and an open package of kratom made and sold by Kratom Distro next to Krystal’s unconscious body. She was pronounced dead at the hospital. The Palm Beach County Coroner says the cause of death was “acute mitragynine intoxication.” Mitragynine is the scientific name for the plant used to make kratom. Kratom is sold as a safe, all-natural dietary supplement but the DEA lists it as a “drug and chemical of concern.”

Kratom Products Failed to Warn Consumers

The wrongful death lawsuit filed by attorneys at mctlaw alleges that Sean Michael Harder, and his business are responsible for Krystal’s death because they marketed a dangerous product without warning consumers of what could go wrong. The complaint also alleges that Grow LLC and Kratom Distro marketed kratom as an all-natural medical cure-all (see exhibit B of the complaint).

Holding the Kratom Industry Accountable

Attempts at Regulating Kratom

The Food and Drug Administration (FDA) issued several import alerts to the public concerning kratom. To date, kratom is not FDA-approved. In 2016 the Drug Enforcement Administration (DEA) tried to classify kratom as a schedule 1 drug, similar to heroin, ecstasy, and LSD. However, lobbyist groups like the American Kratom Association have successfully kept kratom off the DEA drug list, claiming it is safe and natural.

Widespread, Easy Access to Kratom

Kratom is incredibly easy to buy, which fuels a growing crisis. A few states and cities have banned kratom completely, including Alabama, Arkansas, Indiana, Tennessee, Vermont, Wisconsin, Washington, D.C, Denver, CO, Sarasota, FL, and San Diego, CA. For the rest of the country, Kratom is available to purchase with almost no restrictions. Kratom is sold at gas stations, smoke shops, bars, and online. Some states don’t even have laws in place to prevent sales to minors.

Walden Local Meat Co. and Their Members Donate to Local New England Food Banks to Help Provide More Than 5,000 Meals to Those in Need

Walden Local Meat Co., a community-based, direct-to-consumer share program that hand-delivers high quality meat to members’ doorsteps from farms across the Northeast, and their members have donated more than 2,700 pounds of meat to local New England food banks including Abenaki Helping Abenaki and Pine Street Inn, through its Thanksgiving member donation program. Each Thanksgiving season, members can purchase meat that is given directly to local nonprofits.

This year’s donations are expected to help provide over 5,000 meals to those in need this winter. These donations are coming at a time when food insecurity is nearly doubling pre-pandemic times. Project Bread estimates that one in six households in Massachusetts are food insecure.

We want to be able to treat the whole person –- identify and address the issues that precipitated their homeless situation, so we can help ensure lasting freedom from homelessness and instill the confidence in them that they can become and remain independent members of our community.

To show proper representation to all their services and better highlight their mission, Harmony House Homeless Services is excited to announce they have changed their name to Wayfinders Ohio.

“We do so much more than exclusively provide shelter to the homeless population. And we just felt the old name didn’t accurately represent the full scope of what we do here,” said Executive Director, Kelly Blankenship.

The name Wayfinders Ohio is meant to represent how the shelter not only provides safe housing but also helps individuals and families experiencing homelessness find their way back to the life they want to live.

“The vision we have for Wayfinders is to do more than just get people off the street for a short period of time,” said Blankenship.

To do this, Wayfinders Ohio makes sure to adhere to the needs of each individual that walks through the door. They focus on the immediate needs of the person first — providing a warm bed, clean clothes, food, a shower and more so they can take a moment to breathe and rest.

After a few days, the Wayfinders team will begin to work with them to better understand their circumstances and individual needs. They work together to create a custom plan that works through the obstacles standing in their way to long-lasting freedom from homelessness. Often that means connecting them with the resources that will be right for them, including various types of medical care, employment training and education, legal help, addiction services and more.

These resources already exist but are spread throughout the community. Issues like access to transportation and technology can make it difficult for a homeless individual to easily connect to the resources they need. That’s why it’s important that a shelter brings all of these elements together in one place.

Wayfinders Ohio is changing the story to helping individuals and families experiencing homelessness, and with that, a name change was necessary.

AMI Meditation Reduces Physician Burnout and Stress While Elevating Compassion Levels––Even During the COVID-19 Pandemic

In a new clinical study, peer-reviewed and published in the November 2022 issue of “Lifestyle Medicine” by John Wiley & Sons Ltd, medical researchers found that the regular practice of AMI Meditation and its allied disciplines significantly reduced burnout and secondary traumatic stress, while increasing compassion satisfaction levels in physicians and other healthcare professionals. This historic research study, which promises far-reaching protection against physician burnout was, in part, gathered during the increased stresses of the COVID-19 pandemic.

Although the adverse effects of physician burnout were acknowledged as early as 1974 by Clinical psychologist Herbert Freudenberge, the increasing physical, mental and emotional pressures on all health-care providers has never been satisfactorily addressed by Mind/Body Medicine. In fact, in the September 13, 2022 issue of the Mayo Clinic Proceedings, published research co-authored by the American Medical Association now shows how the COVID-19 pandemic magnified long-standing issues that have accelerated the U.S. physician burnout rate. At the end of 2021, nearly 63% of physicians reported symptoms of burnout, up from 38% in 2020. Research further shows that large-scale change is needed to address the physician burnout.

According to the AMI Meditation study’s lead author, Mark Pettus MD, “From 2017 through 2020, a total of 54 attending physicians and health-care professionals at the annual AMI Meditation® holistic mind/body medicine conferences participated in this prospective study. Having been taught the mantra-based AMI Meditation curriculum, in addition to receiving abundant tools and support, these physicians and healthcare professionals were followed for 6-months. Using validated measurement tools to evaluate burnout scores, compassion fatigue and secondary traumatic stress, nearly all participants demonstrated significant improvements in all measures at 3 and 6 months of study follow up. These were statistically significant findings. Even for the subgroup of participants (n = 6; all physicians) who completed the second half of the study from February to April 2020, in the midst of the early stages of the COVID-19 pandemic and “quarantine,” there were sustained statistically significant improvements from baseline to 6 months in the secondary traumatic stress scale scores and, although not statistically significant, sustained numerical improvements were noted from baseline to 6 months for the burnout scale and compassion satisfaction scale scores, as reported in the AMI Meditation Study Table A2. From baseline and 6 months, secondary traumatic stress scores were reduced by 25.7% (p = 0.017), burnout scores were reduced by 21.5%, and compassion satisfaction scores improved by 13.2%. Of note, the changes in the three scales were numerically similar to the changes found for the whole study cohort.”

National Networks Unite to Connect Survivors of Trafficking With Pro Bono Laser Tattoo Removal Services

Board-certified American Society for Laser Medicine & Surgery (ASLMS) physicians across the country have volunteered to remove branding tattoos free of charge for survivors of trafficking! This pro bono service, known as the New Beginnings Tattoo Removal Program, has been created in partnership with the National Trafficking Sheltered Alliance (NTSA), a community of service providers working to enhance resources and increase access to care for survivors of trafficking, and is open to all survivors with branding tattoos. By partnering with NTSA’s network of 100+ affiliate members that collectively identify and serve the needs of survivors across America, deserving individuals are now able to connect with highly skilled ASLMS physicians who are interested in delivering this vital service free of charge.

Many survivors are branded by their traffickers with tattoos conveying ownership, including names, symbols, and barcodes. This dehumanizing practice can often be a reminder of the trauma a survivor has endured and therefore act as a barrier in the healing process. This makes the removal of the brand an important step in allowing survivors to reclaim agency over their bodies. A recent study published in the Lasers in Surgery and Medicine Journal, Liberating More Than Light: Laser Removal of Branding Tattoos is Impactful in the Recovery of Sex Trafficking Survivors (https://onlinelibrary.wiley.com/doi/10.1002/lsm.23612), presented a needs and impact survey of 40 programs serving survivors. Of the estimated 3,200 survivors supported by these programs, over 1,000 were at an appropriate recovery stage to undergo laser tattoo removal. On a scale of 1–10, with 10 being the most impactful on recovery, the removal of branding tattoos received an average impact score of 9.2.

Paul M. Friedman, MD, who serves as President of ASLMS, proposed a philanthropic campaign establishing a national directory to connect sex trafficking survivors seeking the removal of branding tattoos with interested ASLMS board-certified physicians. “ASLMS is the ideal professional society to establish a philanthropic national registry of physicians for survivor tattoo removal,” said Friedman. “Our board-certified physicians have the expertise and devices to help human trafficking survivors in their recovery process. In just a few months, 75 members have volunteered, and we plan to expand the network even further across the country.”

Excelsior Integrated Medical Group (“Excelsior”) and Rendr have announced today that they will combine to form New York City’s leading integrated multi-specialty medical group and related professional management service organization dedicated to providing world-class, value-based healthcare to the medically underserved Asian community.

The combined enterprise, which will operate under the name Rendr, will include approximately 200 providers operating out of nearly 100 medical sites across Brooklyn, Manhattan, Queens and Staten Island. The new venture is backed by Ascend Capital Partners and Kain Capital, two healthcare focused private equity firms. Dr. Richard Park will serve as the company’s Chief Executive Officer with Dr. Henry Chen and Dean Lin serving as co-presidents.

Excelsior started in 2013, as a financially integrated multi-specialty medical group, with three primary care physician practices. Currently, Excelsior has more than 80 providers from 12 clinical specialties across 21 divisions at 59 sites in Brooklyn, Manhattan, Queens, and Staten Island. Since 2016, the medical group has seen an average revenue growth rate of 35% per year and rebounded from the COVID-19 pandemic with a revenue growth rate of 52% from 2020 to 2021.

Rendr is a primary care focused, multi-specialty medical group, providing 11 clinical specialties through its 40 locations in Brooklyn, Manhattan, and Queens to serve a predominantly Asian patient population of approximately 100,000. The medical group started in 2019 through a merger of 17 physician practices in the New York City Chinese community. Its founding executives include several former top executives from CityMD, the leading urgent care group in the New York and New Jersey Tri-state Area.

In 2021, both Excelsior and Rendr earned top CMS quality scores from most government-funded insurance plans in New York City, along with entering into risk-sharing contracts with several major Medicaid and Medicare payors.

In addition to focusing on primary care, the combined enterprise will provide approximately 20 clinical specialties to manage the health of a patient population of more than 200,000 at close to 100 clinical offices throughout Brooklyn, Manhattan, Queens and Staten Island.
